Motor Insurance Taking Too Long To Payout

Hello everyone....

I hope someone can help me.I had a car accident on 13/02/08.A guy with a new vectra went into the back of me.He admitted fault and gave me his details.I informed my insurance company(insureyourmotor.com)about the accident however it has been 4 months since my accident and I haven't been paid out yet.

When I rang my insurance company after a month from the accident and I asked them
why it was taking so long to sort my claim out.They told me that the third parties insurance cannot comment on liability just yet and it could take up to 3 months(13/05/08)

When 3 months passed I rang my insurance up and this time they told me it will take 1 more month(13/06/08)
I rang them up this morning and they told me that it could take up to july (5 months after accident) to sort the claim out.

Can somebody tell me how long do the third party have to make a comment on liability and when can I take them to court.The accident was not my fault and I have been without a car since 14/04/08 (thats when my courtesy car was taken back off me).

    You need to start applying more pressure.

    Do you have legal cover?
    If not then you need to be talking to a claims advisor. I can't advise on which comapny I'm afraid as I have no experience.
    They will sort you out with a hire car and then the other side might speed up a bit.

    Sorry to say it but being quite reasonable and not making any demands will make them go slower.
    Start getting a hire car bill mounting up and they will start moving a bit more quickly.
    You aren't doing yourself any favours by being Mr Nice Guy.
    Get yourself a hire car, you are entitled to it.

    I have 3rd party f/t and yes I have legal cover.The accident happened on the 13/02/08 and I was given a courtesy car and then on 14/04/08 it was taken back.

    I have been calling angel assistance nearly every 2 days.
    If i get a hire car will I have to pay up front?

    You can issue proceedings at any time after the three months is up.

    Sorry geri I don't know what you mean.Do I have to issue proceedings myself or will my insurance do it?
    The 3rd party insurance are carrying out inquiries and would not disclose the nature of their inquiries.To be honest I don't think my insurance are doing their best to get my money for my car.

    Hi yasmeen ... have to confess to some confusion.

    You mention your insurers - but if you are third party cover - then your car insurers are not involved - correct?

    You also mention Angel Assistance - they are a claims management/recovery/legal assistance company - am I correct in thinking that this is who you mean as acting for you - and probably arranged for the replacement car - correct?

    If that is correct - then as another poster said - you need to apply pressure there - very much so imo.

    How?

    Ask them to give you a full detailed update on why this is taking so long?

    Ask them when, if the delay continues, they would consider instigating legal action against the other driver (the action would be against the other driver - then his/her Insurers would get involved again - if everything is ok with the other driver's insurance)

    I mention that last part because sometimes the cause of a delay can be questions about the validity of the other driver's insurance - it does happen - and that is why you need a detailed update on the position.

    Let us know how you get on.

    Only other question(s) I have is - are you able still to drive your car, has it been repaired, and if so, are you out of pocket for the repairs?

    To be honest I don't think my insurance are doing their best to get my money for my car.
    It's TPF&T, that is to be expected.

    Did you take legal expenses cover? If so, then they should be acting on your behalf to recover your costs. The insurance company will sit back and wait for thing to happen giving a periodic chase. The legal team on the other hand should be pro-active and you should be as well.

    Yeah i have 3rd party fire and theft.My insurance are involved in sorting my case out.
    Angel assistance are acting on my behalf and I got the courtesy car from Help Hire.

    I have been ringing my insurance company every 2 days and they fob me off saying different things.
    1st) I was told that it will take 3 months after the accident to take legal action.
    2nd)After the 3 months passed on 13/05/06 i was told they will take legal action a month later on 13/06/07.
    3rd)And now iv been told by my insurance company that they will take legal action after 13/07/08(which will be 5 months after the accident)

    The other driver was in a new car it was a 08 plate vectra and he seemed like a good bloke who gave me address and other details.His insurance company wont disclose the nature of their inquiries and will not say how long they gonna take.

    My car was classed as a write off by a engineer and was taken away.The car was valued at £2000 which I agreed to.I sent my log book and MOT away to my insurance soon after the accident.

    Why are your insurers "helping you out" - you are on your own when it comes to sorting out any damage to your own car.

    Who told you to send your log book to your insurers? They definitely won't be paying you the write off value.

    You need to get someone working for you - maybe contact a claim handler or solicitor.
