After going through the Daxon disembodied voice process, I finally got to speak to a "live" person:
Nessy: I would like to inform you that this call is being recorded
Daxon: Oh, why?
N: On 23rd September 2005, you entered into a legally binding contract to supply me with a fan heater, catalogue number 4758775 priced £9.99 less an unrestricted introductory offer of £10 discount including free P&P under offer code 0665. I have in front of me dated print screens of the entire transaction. The order confirmation states that my account has a zero balance - nothing to pay, and the delivery note for the fan corroborates this. yet the statement I received today dated 11th October is demanding payment of £9.99. I would like to remind you that a legally binding contract was entered into, and by demanding payment of £9.99, you are attempting to obtain money by deception.Where did you get the offer code from?
N: Contained in an email from yourselvesLet me check that........(long pause) our email system states that the £10 discount only applies to orders over £15.
N: The documentary evidence I have here in front of me places no such restrictions on the offer. If you do not immediately apply the discount as stated in the original binding contract, I will be placing the matter in the hands of my solicitor, and forwarding all documentation to the Trading Standards office.Oh....as a "gesture of goodwill" I'll cancel the statement for £9.99, clear the account balance and report a fault to our email department.
N: So you confirm that you will revert to the original contract and honour the unrestricted £10 introductory discount?Yes
N: So you confirm that my account balance will be returned to zero?Yes
N: I expect written confirmation of this by return of post. If I have not received this by Friday 28th October, I will be instructing my solicitor to issue proceedings against you.I'm doing that now, and it will appear on your account on the next working day
N: Which is?Monday
N: I will be checkingNo problem. Is there anything else I can help you with?
N: Only to ensure that the promises you have just made, which have been recorded, are honoured within the agreed timescales.
We shall see what happens........0
