DMP American Express

Moring All,

I tend to be more of a lurker on these boards until i have a question!
Todays question, dh and i set up a DMP about a momth ago and the first lot of payments are going through and for the first time in quite a few years my account is in credit :j
I thought we were doing really well and on Friday i get in after collecting the baby and there's a mesage on my a/p from a guy who i called back as i didnt know who he was but he knew me....
It turned out AE have sold my credit card debt of £9,000 to a debt colletion agency. The guy who i spoke to was very rude, demanded the money and was threatening me with bankrupcy. He went on to say i was earning £50k a year and had equity inmy house to pay it. I may have been earning near 50k before i had my baby and that's why we ran up the credit cards.
I called cccs who were very helpful and said its probably just a threat....

Can anyone with experience out my mind at rest as its been on my mind all weekend and set the ibs off again!

    Hi,

    Do you know who they sold it to? In my case it was a company called RMA. I have to say that they were very good with me - took my Payplan details called them to find out when they would be getting paid and then called back and asked for a token payment. I haven't heard from them since and they have dealt with Payplan directly.

    I very much doubt they would make you bankrupt. It would cost them money to do it and would probably result in them getting less back than they would from your DMP.

    It's simple really... They can't have something you ain't got :)
    You're on a DMP and you need to stick to it. Offer them the payment as per set out through CCCS. Although personally I'd ask them to prove they have indeed bought the debt before paying them but check with CCCS on that.
    So long as you keep sending the cheque every month then even IF they tried to take you to court the chances are very small the judge would give them a charging order or anything else as you are obviously trying to repay what you owe and have taken steps to repay them.
    Most DCA will try to bully you so if they call you again tell them your CCCS reference and inform them to contact CCCS about the debt and hang up the phone. Then follow it with a letter informing them that any further communication is to be through CCCS or by letter only! Send recorded :)

    Just don't speak to them on the phone - they will do everything they can think off to make you pay them more than everyone else and often use both illegal and morally repugnant methods and threats. Stick to your guns :)

    Thanks a lot for your support/advice.

    One other quick question re dmp. I occasionally earn bonus's and would like to do some home improvement too as we're staying put no instead of moving.
    Should i give the dmp an increased amount on certain months and spend a bit on the house or put one or the other first?

    Personally, I put bonuses into a contingency fund (they are so small anyway) for emergencies. A DMP is based on your regular income. I've been told that it's best to keep the payments regular anyway and that if you paid more 1 month some creditors would assume you could afford more and start calling again writing letters again.

    The guy who left a message on your answer phone - was he calling from a company called Allied International Credit, by any chance?

    They called me regarding my Amex credit card debt and came over very aggressive and threatening all sorts, bankruptcy, losing my house etc etc.

    In the end I told them to P*** OFF and I never heard from them again. A few weeks later Amex informed me the debt had been passed to RMA Resolve who have always been very polite and accepted £30 per month towards my 3K credit card debt. They charged a small interest for the first couple of months then after that interest was stopped. My balance is slowly reducing and they give me NO HASSLE whatsoever.

    Stick to your guns - they can't have what you haven't got!!
