Help with letter

Hi
I'm not sure if I'm in the right place & sorry if I'm not.
As anyone who knows me from the OS board knows, I have my BIL living with me as his marriage is in melt down. Today he went to collect his son & found a pile of unopened letters, he opened them & discovered that his wfe is still taking out loans.
I thought there was a letter he could write & send to the local paper? Saying he is no longer liable for her debts? Am I correct? or is there something alse he should be doing.

Local paper? Nothing I've heard of before. Are the loans in joint names? If so he is equally liable for any debt. If he didn't sign anything when they were taken out and don't have his name on them then he has nothing to worry about.Total 'Failed Business' Debt £29,043

He won't be liable for any new debts she takes out as he won't be signing the loan applications. Any current credit facilities she has access to in his name or joint names he needs to contact ASAP to have stopped. So any joint bank accounts he needs to inform the bank that they have seperated and that he wants them to stop any further credit on the accounts being taken out etc and if she has second cards on his credit card accounts he needs to cancel them asap!
Don't think sending a letter to the local paper will do anything but infuriate his ex!DFW Nerd #025DFW no more! Officially debt free 2017 - now joining the MFW's!

Thanks for the replies. I remember seeing notices in the paper about not being liable for debt. I think the smaller loans are in her name, the larger one is in both, she must have forged his signature, he has all the details now, so he can phone them & try to sort it out.

I think accusing her of having forged his name is a very big leap to make at this stage... However - if she has indeed forged his name then he needs to contact the bank and inform them and they will advise him to contact the police as this would then be a fraud issue and a criminal matter.
The smaller loans in her name will have nothing to do with him - they won't affect him and no-one can chase him for the money if she doesn't pay it.
The joint loan (if it's joint and HE signed it) they WILL come after him for if she should decide not to pay or go bankrupt... I would recommend that he sees a solicitor ASAP about this and if possible get her to agree to split the loan and each take half the debt and close that account down as soon as he can. Otherwise he might be standing with the whole amount owing on that one.
I don't think putting a notice in the paper would have any legal standing other than maybe if someone have moved home after re-possession and then getting lots of bailiffs etc come looking for Mr X. By posting a notice in the paper they might avoid come of it as a quick search of the internet should bring it up and would mean the creditors would know someone else lived at the address now? I've done a quick web search but I can't find any information on publishing notices that he's not liable for her debt... Mainly because... well he never was... under law. He's responsible only for HIS debt - ie anything he puts his name on.
As said then if she's faked his signature then it's a fraud matter.DFW Nerd #025DFW no more! Officially debt free 2017 - now joining the MFW's!

What will the consequences for their son be . Is he able to pay child maintainace ? Maybe he needs to find out why shes taking out loans?0
-
His son is only living with his mother till July, he will be staying with his Dad here with me from then on until BIL get a place of his own, so I don't think BIL will have to pay maintenance.
As to the forging of his signature, he will see his solicitor about that later this week.
As to why she is taking out loans there is a breakdown of their finances below.
Mortgage £1300
Other loans to pay of previous arrears £1766
Council Tax £250 paying off arrears
Gas £350 on a key meter
Electricity £450 on a key meter
Horses x 3 £600
Dogs x 4 £135
Cats x 5 £120
Telephone £150, cut off, but paying off arrears
Mobile Phone £150
Water £52
TV licence £9
Food £750
Total £6082
BIL left the marital home a few weeks go, he is contributing approx £2000 a month, which is the bulk of what he earns.

i'm just wondering why he opened letters addresses to her only in what I presume to be her own home. Seems a huge liberty to me.MF aim 10th December 2020 :j:eek:MFW 2012 no86 OP 0/2000

Good I thought it was just me...
Horses... Uhmmm SELL THEM! If BIL can't bear to sell them then get them out on loan os they might make a little money and at least aren't costing £200 each a month.
Dogs x 4 £135 - What on earth do you manage to spend £135 on??? Insurance £10 each, food £10 each that's not including discounts for insuring several animals or bulk buying food. Total: £80.
Cats x 5 £120 Again this shouldn't be more than £80 - nearer £60 if some slightly savvy shopping is done!
At the moment animals alone are costing £850+ With debts at the level they have they seriously need to rethink their priorities! If they want to keep any of the animals they have to cut the costs somehow!DFW Nerd #025DFW no more! Officially debt free 2017 - now joining the MFW's!
