    why do council tax want to see your bank statements? i'd avoid it if i were you, they might class the money from your father as income although i suppose you could say he's been helping you out as your tax credits haven't come through yet and you will be paying the money back to him as soon as your tax credits arrive?

    try your local tax office, they gave my sister some interim payments to help her feed her children while her tax credits were delayed. good luck!

    If Council Tax Benefit want to see your bank statements they will just not sort out your claim until you do, you can't avoid it.

    Receiving regular money like the £100 is clearly a form of income and you would have to declare it.

    How are things going snow_queen, did you get anything sorted out?

    if she said it was a loan to help her out while the tax credits were being sorted out would that make any difference? if she said she would be repaying it when her money arrives? will they still class it as income then?

    As I understand it, it won't matter where it's coming from, it is regular income of £100. A one off gift or loan from her father would be a different matter, though for Council Tax Benefit she would have to be careful that any gift didn't take her above the capital limit.

    well i spoke to my MP's secretary and she spoke to tax credits and they are going to do a manel payment for me of the money owed from when I first put in the claim until now, i'll get the payment just after xmas - im hoping if MY calculations are right that its around £100 per week so I'll get quite a lump sum, but until i get that money Im not gonna rely on it! The man from tax credits is meant to be ringing me the MP lady said

    Im worried that Ill be in trouble now with tax credits for not saying about the money from my dad

    is your dad going to carry on giving you the money and never ask for it back? if so then i suppose it should really be classed as income. i don't know if you'd get into trouble exactly with tax credits, i doubt they've got the time or manpower to take you to court but i imagine that if they do find out they will reduce your entitlement by £100 a week and ask for back-payment too. it would be the same if you were on income support, all income has to be declared. when i was on IS i declared my earnings from a part time avon round and also the commission i eanred from my sister and mum buying from my catalogues. it hardly ever went above the limit of what i was allowed to earn per week but i would have been in trouble if i hadn't told them and they found out about it. i don't know if there are limits with WTC and CTC, probably not :-/

  • basically my dad kindly wanted to give me another year off after having my daughter so the £100 a week he gives me stops in march.

    If I wait till jan and provide nov and dec bank statements, i can say it was money dad was lending me because I split with husband 7th november. can i??

    what will this mean? Im SO SO worried now, and worried bout the tax credits etc that im gonna get into trouble

  • snow_queen, I have to ask are you wanting to do this correctly or not? If you get £100 per week, a fair amount of money, from your father you must declare it to all interested parties. It is not a loan nor a gift, it is money that enabled you supposedly not to have to work.

    It will probably affect any claim for council tax benefit but may not affect WTC provided you satisfy their other criteria of working 16 hours per week etc.

    You won't get into trouble with TCs, so don't worry. It will make a difference to the amount you are entitled to, but your current award is based on an estimate of this years income anyway. And when I say estimate, they base it on last years income, but you can update that to anything you like......anything at all! It is only at the end of the year, when you get your annual renewal form, that you have to tell them your actual amount of income for 2004/05. So as long as you include it then, you'll be OK.

    Just be aware that if you leave it until then to tell them about this extra income, you may have been overpaid and end up owing IR money (which they will deduct from your 05/06 award).

    Also to note, it is only income that this applies to. Anything else (number of children, childcare costs, working hours) if they change you have to tell them straight away. With income changes you choose whether to tell IR now, or wait until the end of the year.
