Well I phoned up my bank before I sent off the second letter as I was advised to in the letter from them, and basically was offered a managed loan and nothing else. They totally denied (several times) that they had heard that hardship cases needed to be dealt with now, and were not covered by the waiver from the FSA.
I got a reply to my second letter yesterday which basically said "You need to call us again, as advised in our last letter and give an SOA". I tried to do that two weeks ago but there were not interested. So what do I do now. Should I phone them up tomorrow, and comply with their request, as I feel they are doing this as a delay tactic. Two weeks ago they claimed that they had nothing in place for hardship cases, and yet now they want to know my SOA.
Should I tell them tomorrow that I want this cleared up by wednesday or else I am filing a claim with the court as per my second letter to them nearly two weeks ago? I phoned the bank this morning again, spoke to 5 different people in 45 minutes, not one of them would take my SOA so I suppose its off to court I go. You will need to make all efforts off reclaiming the money first before taking any court action.
Write a second letter and make it clear of the action you intend on taking.0 -

Basically I am useless with forms. So I have the claims forms for court and would like a wee bit of help.
Obviously I am the claimant, so my details go there.
HSBC are the defendants, so I put their details in there.
Brief detail of claim. Can anyone help me with this, just a basic what should I say? Charges were made between October and December 2007. Would I mention that I am wanting it dealt with now because I am suffering from hardship in that part?
Particulars of claim. Again help please.

Ok so all in all I am claiming £557.88, for bank charges plus the 8% interest (up until today). Am I able to add another fortnight on to that for the case to go through the court system, as it will be taken to the court tomorrow and the claim handed in. Your POC should include this:The claimant claims interest under section 69 of the County Courts Act 1984 at the rate of 8% a year, from [date when the money became owed to you] to [the date you are issuing the claim] of £ [amount of 8% interest] and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of [enter the daily rate of interest]
The daily rate is just the charges x 0.00022. eg £475 x 0.00022 = £0.11p
