DMP help please!!

I've sent letters to all my creditors, telling them I'm moving onto a DMP. I've used template letters and forms from the National Debtline site but am doing this on my own. I haven't had replies yet, very early days, but since the day when they'd have receievd the letters I've been getting phone calls from Littlewoods at least 3 times a day. I haven't answered the phone as after reading on here, I decided to keep it all in writing, rather than trying to explain or defend anything to a random person over the phone.
I must say though, I'm feeling very harrassed by the constant phone calls. I plan to pay the amount I've worked out on the date I've offered and hope that none of the creditors threatens me with court, but what happens if the creditor just continues to chase me, as Littlewoods seem to be doing? What if they either disagree with my DMP letters or ignore them??

Just send them a letter requesting that they remove your number – they should do this for you.
If a creditor does not accept the payments – send them anyway as it will still come off the balance. Hi HB, just to let you know, you are not alone. We've been on a DMP with CCCS for a couple of months now, and the only creditors being &**$$'s are Halifax Credit Card. They've ignored all correspondence from both us and CCCS, don't even acknowledge the DMP, and continue to call at all hours, Sundays, you name it. now they've started phoning my wife at work, despite writing to them requesting all correspondence is to be in writing.
CCCS Sarah, apart from writing and mentioning the Administration of Justice act, is there anything else than can be done? I've even thought of a whistle down the phone!:rolleyes:0 -

Whistling maybe good or singing:rotfl:
I have attached an old post that you may find useful; it’s a letter RAS has put together regarding the Administration of Justice Act. If you have more than one account with the same creditor, you would ned to send one for each account.

If you still receive the phone calls after this make a log of the calls – dates, times peoples name etc.I am a Debt Counsellor that works for the CCCS and have specific permission from Martin, to post on these boards to try and help those in debt. well, none of them have been answered, but I have them logged as missed calls on the phone.
I sent a recorded letter today quoting the AoJ act, so they'll have it tomorrow.0 -
Hello Hillie Billie
and welcome and well done on doing your own letters too, ive done mine from march this year, got a few of the creditors who were quick of the mark and have accepted payments and some without interest too, fab, but ive found mbna and anyone connected to them been awful.
ive done a similar letter ref the one above from ras, and finally this week, the phone calls have stopped,
also ive sent them complaint letters because they didnt respond to my initial letter and just sent letters and ignored my initial letter, and now they are investigating my complaints - finally we shall see,
ive also cca a few creditors and by monday some will have failed to send me the document and I SHALL be reporting them to the appropiate authorites - its the law to have a copy of the cca and i wish to check all aspects of the debt for my own personal financial peace of mind
ive continued to pay my pro rata payments but from next week, will have to investigate further on my next plan
i do wish to continue paying the debts off, but sending me a full tree of papers is not helping my blood pressure nor the enviroment.
So i do hope ive not put you off in any way, just wanted you to be aware that will take a little time and do your stuff in your own way, i send all my letters by signed for delivery about 1.08 first class and find its fine, that way i do have a record of them receiving my requests and my complaints,
To me now this is my mission - im off ill but somehow gaining all the knowledge ive gained over the past couple of months has really inspired me to get better.
Yes, i admit i was frightened at first, its the first few steps but as time goes by the knowledge and fab help here just helps you along, ive subscribed also to lots of threads here and i learn all the time.
Anytime you want a chat, please post or you can pm me, and if you want a copy of any of my letters ive sent not a worry, to anyone who needs help, ive been helped me by many and so im happy to help others that are new like i was back in march
good luck to all, and keep your chin up
ciao have a fun day MAZSealed Pot Challenge member 1525

Hi all,
Thanks for the replies and the encouragement (esp Maz - thanks!).
It was a weight off after even just sending the letters, as I've been trying to keep up just the min payments for so long, hoping things would get better. I'm hoping that at least this way, something will actually get paid off the debts and I can sleep at night.
I think the phone calls are in response to the letter as they'd stopped ringing me before and then became so frequent after they'd have received it. I'll get my phone numbert taken off, so they've no excuse to ring me.
I guess the DMPs are often treated this way by the creditors? Though if they turned nasty and threatened me with court, they'd end up with the same result, i.e. the same amount off me every month as I suppose the court would look at my finances and come to the same conclusions I did!

Hi HB. You might find that it takes a while for the phone calls to stop even after you start your DMP as creditors usually like to see a few regular payments going through. I've had continuous hassle from Barclaycard/Mercers who have ignored every letter I've sent them even though I've got proof of signature including my CCA request which was sent in March and not even an acknowledgement or a CCA has arrived yet (in the process of writing the necessary letters) and Halifax who are refusing to accept my monthly DMP payments and like Barclaycard ignore all my correspondence. MBNA have been great with me surprisingly and they are my biggest creditor!
I ignore their calls now but I do keep a log of dates and times that they have called - I have an A4 pad, with several pages filled in, both at home and at work. I'm finding they go quiet for a few days and then start up again. With the help of people on this forum, I've learnt to cope with them by just ignoring the calls basically.
I'm of the opinion that if they try to take me to court, hopefully the court will see that I am making every effort to pay the debt off but they are being difficult and refusing to accept my payment, as you say, it may not look too good on the creditor.
Good luck. Feel free to PM me if you would like any further help.Debt 30k in 2008.:o Cleared all my debt in 2013 and loving being debt free

hiya HB and D in D
many thanks for your comments - its true also what Deep in Debt says, to note down the phone calls received, should it go to court its evidence,
however, in all this debt free journey i find different creditors do different things - whilst Deep in Debt says you have had great responce from MBNA yet to me they have just sent me a full tree of paperwork, However, ive put in a official complaint and now await with bated breath their responce,,,,,,
I really really do want to sort an agreement out, but thats what this journey is really all about, if nothing else its character building for yourself,
lol
im now of the opinion that if any of my difficult creditors just continue to ignore me im writing an official complaint and letting it run through their complaints proceedure, and since ive had acknowledgements from them, its the start of my full paper trail, should it go to the courts,
if i get a final responce and its not reasonable, off to the fos i go,
keep taking the tablets is what im doing, but hey this is one hell of a merry go round,,,
Ciao for now shout if anyone has any concerns we will all try and help
