Have I Told Mum The Right Thing?

My mum is getting hassle from Moorcroft. She has been sending them money for several months but they called constantly asking for more which was really starting to depress her. I told her not to answer the phone, but she did because she worried it's something important. I persuaded her to change her number which she did, and when the letters came I told her to send back her I & E along with the amount she had been paying. She has told me today that they sent a letter threatening her with bailiffs, so she called them and they told her unless she ups her monthly payments, someone will call to remove goods.

I told her this morning that they cannot do that, it's just a threat, carry on with your normal payments and if anyone knocks at the door DO NOT let them in. She has called back and said that someone has phoned her (they got her new number when she called them) and told her they will take her to court and bailiffs will be sent. Again I told her if she's gets a CCJ they will not take her oven or cooker or sofa, the court will assess how much she can reasonably pay and that will be the last she hears from Moorcroft. She's at her friends at the moment because she's scared to be at home in case someone comes and her friend has told her I am wrong and they can take her things. Have I told my mum the wrong thing? She's so upset and I don't want to give her a false sense of security.

  • makes me so angry the tactics they employ. How much is the debt for...how much should she have been paying and what is the amount she is currently paying. You could consider writing to them on her behalf quoting the harrasement law (someone will let you know exactly what to do and may even have a sample letter) as that is what this constitutes too.

    Would it be possible to go back to the original creditor (depending on what the debt was for and whether the co have employed them to assist with debt collection or whether they have sold the debt.)

    I would def take it further.

    Well done.

    We need to know a bit more about this.

    What sort of debt is it? How long ago did she borrow the money, buy the goods. When did she start paying Moorcroft?

    What does she earn and how much is she paying?

    We may need mum to send a CCa letter, or a statute barred one but until we have more information cannot advise which.

    Defo need the telephone letter and the OFT Guidelines so that mum understand that this shower are breaking the rules and should be reported just for what they have done so far.

    Unless they have a court order, they cannot just send the bailiffs and she would know if they had sought one. Even then she does not have to let the bailiffs in and they cannot take normal stuff needed for living.

    Cannot get the link for the full OFT guidelines right now but to give you a clue have copied this from another post

    I have cut out some relevent info from the document, but it is well worth reading. I have oput the ones I think have been broken in italics

    2 UNFAIR BUSINESS PRACTICES
    Communication
    2.1 It is unfair to communicate, in whatever form, with consumers in an unclear, inaccurate or misleading manner.
    2.2 Examples of unfair practices are as follows:
    a. use of official looking documents intended or likely to mislead debtors as to their status, e.g. documents made to resemble court claims.
    b. leaving out or presenting information in such a way that it creates a false or misleading impression or exploits debtors' lack of knowledge
    c. those contacting debtors not making clear who they are, who they work for, what their role is, what the purpose of the contact is
    d. unnecessary and unhelpful use of legal and technical language, e.g. use of Latin phrases
    e. failing to provide debtors or creditors with information on status of debts, e.g. not providing requested balance statements when reasonably requested
    f. contacting debtors at unreasonable times
    g. ignoring or disregarding debtors' legitimate wishes in respect of when and where to contact them, e.g. shift workers who ask not to be telephoned during certain times of the day
    h. asking or instructing debtors to make contact on premium rate telephone numbers

    Physical/psychological harassment
    2.5 Putting pressure on debtors or third parties is considered to be oppressive.
    2.6 Examples of unfair practices are as follows:
    a. contacting debtors at unreasonable times and at unreasonable intervals
    b. pressurising debtors to sell property, to raise funds by further borrowing or to extend their borrowing
    c. using more than one debt collection business at the same time resulting in repetitive and/or frequent contact by different parties
    d. not ensuring that an adequate history of the debt is passed on as appropriate resulting in repetitive and/or frequent contact by different parties
    e. not informing the debtor when their case has been passed on to a different debt collector
    f. pressurising debtors to pay in full, in unreasonably large instalments, or to increase payments when they are unable to do so
    g. making threatening statements or gestures or taking actions which suggest harm to debtors
    h. ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment
    i. disclosing or threatening to disclose debt details to third parties unless legally entitled to do so
    j. acting in a way likely to be publicly embarrassing to the debtor either deliberately or through lack of care, e.g. by not putting correspondence in a sealed envelope and putting it through a letterbox, thereby running the risk that it could be read by third parties.

    Hi Dubsey,

    You are doing the right thing!

    A Bailiff can only come out if your mum has defaulted on a CCJ. Has your mum got a CCJ? If she did get a CCJ she would not have her cooker etc. It is just a payment agreement made through the courts and a marker on a credit file. Sounds like they are just making threats to scare her into paying more.

    The amount your mum pays should to be based on her SOA. It has to be based on an amount that is affordable to her. So even if they say they are not accepting the payment, send it anyway either through postal order, payment book or standing order – not direct debit. This is so your mum remains in control of the payments at all times. CCCS do have an online facility called debt remedy where you will be able to put together a SOA and this will also give her the best advice and step to take based on her circumstances.     With regards the phone calls, if she put’s a letter together requesting they remove her number from there database – anything important they are going to send in a letter anyway!

    I am writing to express my serious concerns regarding the telephone calls that I have received from your company.

    I am now formally requesting that all further correspondence be made in writing only.

    I demand that these phone calls stop immediately. I am familiar with the terms of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1970 and I believe your harassment places you in breach of these acts. In addition your agent made a number of threats on the telephone that directly contrave the OFT Guidelines. To ensure that your agents comply with the Guidelines in future, I require all communication to be in writing.

    If you continue to call, you will also be in breach of the Wireless Telegraphy Act (1949) and, as such, I will report you to both Trading Standards and The Office of Fair Trading.

    Take further note that continued telephone calls after the receipt of a request not to call may constitute a criminal offence under Section 127 of the Communications Act 2003.

    You will be deemed to have been served notice of my request and I will deem it served by (FULL DATE), I am advising you that any calls received after this date will be recorded with the intention of them being used as evidence. In the meantime, we will be contacting the OFT and Trading Standards to report your actions.

    You lot are absolute stars! :T

    Just given her a call and she's told me what she can remember off the top of her head. The debt was through M & S on a credit card she'd had for years when she was working. The total outstanding is £748 and she was paying about £17 a month with no problem until she collapsed at work and obviously couldn't work anymore. She first offered £1 a month as advised by the lovely people at the CCCS but when they called asking for £2 she obliged and again when they asked for £3 :rolleyes:.

    Needless to say she is now in receipt of benefit at £49 per week but she does get her rent and council tax paid. She has very high blood pressure but is being pushed hard to get out and get a job by the benefits people, who also know that she is still undergoing regular hospital visits for an -as yet undiagnosed medical condition.

    Bless her, when I just called she's all excited because she's put in an application for a full time job which she hopes means she should be able to start paying anyway. She's 59 in a few weeks, so I'm hoping to help make sure she doesn't overdo things just to get them off her back.

    Tell her to keep sending her payments month in month out. They are just trying to scare her. How much hassle is it to get a van, hire an auctioneer, store the goods etc, and how much are they going to get - a tenner? It's much easier to try and scare people and threaten them with all sorts. I would keep a log of every time they call/visit and let them know you are recording it all and to leave her alone. Obviously don't let them in. Good Luck and I hope your mum gets better soon.

    So they'll take her to court will they? um I think not. For one it will cost them money and 2 the judge will probably just laugh them out of court. If it does go to court everyone will see what scum they are. You know how weak bullies are on the inside - it's basically the equivalent of playground bullies at school. All the best.
