I got "caught" a few years ago on the day trip to Gib.Bought 5 sleeves, separated them in different bags.No problem,i thought. You have to get off the coach,go through customs, thats when the Spanish collared me.Wife and daughter(12 at the time) strolled through with not a care in the world. The customs men said i would have to pay the duty or give the cigs up. As i only paid £8 a sleeve.i said keep um,and walked through with 1 sleeve. So in all i paid £40 for 3 sleeves, not that bad really, god knows how much they are now.

My cousin is staying with me for a while, she is from Toledo near Madrid. She decided to tell me last night that she had asked her sister to post her some cigs from Spain and they are due to arrive in the next day or two. She also told me that when her sister took parcel to State Post office she had to write on packet what it contained so she did?

My question is, is it legal to have these cigs posted over here or will they be confiscated? Its only six boxes I think, enough for her whilst she studies here.

    Many Thanks

If they get intercepted they will be confiscated, and whoever they are being sent to will end with a record with customs, any dutyable goods entered into the country must be accomponied by the owner of said goods.

Strictly speaking if they are for her own personal consumption then she should be contacted with the opportunity to pay the duty on the items, which would make them slightly more than the actual retail value in the UK, if she declined then the goods would be seized.

Just out of interest Phatbear, the guidelines for personal use are 3,200 cigarettes? and a quantity of tobacco of which i am not sure,How do you distinguish what is classed as someone bringing them for re-sale(profit) or someone who actually smokes more than the norm say 5,000, i personally smoke 60 a day(not proud of it)?

How we distinguish is what we get paid for, questions will be asked and a decision will be made based on the answer that the traveller gives to the officers questions.

    Hi

I have just booked a cheap return flight to Malaga, specifically to stock on cigarettes to get me through the next 9 months or so. I have checked out legal limits and as they are just for me, I am confident I will save a fair amount.

However, I would be grateful of any advice as to where I should buy my suitcase full. I want to get the best price possible. I am staying over night, probably in Benalmedena or close to. Thank you.

If you are stopped by customs on the way back it can be very difficult to prove that the amount you have is for personal use.

My parents have an apartment in Nerja and fly regularly to and from Malaga airport. On returning to the UK a couple of years ago they were within the guidelines that customs set and didn't think there would be a problem. They were stopped and questioned individually, basically customs didn't believe them and confiscated all the cigarettes they had. They appealed but they lost so didn't get anything back. So just be careful on the amount you are bringing back

I don't think supermarkets are allowed to sell cigarettes anymore, the best place as already mentioned are the tabac shops

Thank you to everyone who has added comments ot my query.

I did look into going down to Gibralta, but really want to be a ligit' as I can. I am intending on bringing 7000 back, as this will keep me going for 9 to 12 months. I am a little worried about coming back with this many, but I don't really want the cost of going over again. Including the flight and a cheap hotel I will spend about £150, but bringing back 7000 will save me about £1,000, so I'm £850 up. Does anybody have any ideas about proving these fag's are just for me? I would gladly leave them in the custody of the customs people and then go and collect a carton a week!:rotfl:

Also, while I'm here, where is the best place to stay near Malaga airport?

I know ways of proving that these are your fags however that would spoil the fun of any officer that stopped you.

I've let people go with a heck of a lot more than 7000 cigs just because their story was bomb proof, as previously mentioned you can have what you want as long as its for your own personal consumption.

I dont smoke but, as i tell passengers on a regular occasion, if i did i would happily pop over to spain.

The key is if you do get stopped just tell the truth and you wont have any problems.
