damage caused by lodger

My lodger (and friend).

Basically got drunk and flooded the bathroom+ hall. causing damage to the flat below.

Hopefully this is only going to cost about £100ish +some time (due to the nice land lady downstairs).

what is the done thing here? directly take it from deposit (leaving less deposit to fall back on) or asking her directly for the money (then whats point in deposit).

    What next? puking up in the lounge?

    Tell her to take the time off and organize the repairs and make a formal apology to the neighbour, you will see if she is worth keeping on.

    I think it was a geniune accident, but not helped by the drink. So dont think i should be the one that pays for it.

    I know she feels very bad about it and was straight down and appologised to neighbour and has cleared up in our flat.

    I dont want to loose her as a friend or lodger over this so just want to do it in a professional/correct way.

    is it to take it from deposit or for her to pay directly?

    i would think - it's taken from deposit, but because she is not leaving and something has to be done now, she should give you money for a new deposit (or top-up just by the amount needed, or meet shortfall etc)

    so which is the same basically than if she pays directly...

    but really i have no expertise :o
    but that does sounds good to me.

    i would ask her to pay for these repairs in full - and keep hold of the deposit - you don't know if you will need it again in the future - i'm sure you can do this in a friendly way - but do say that if the "drink" causes further problems she will have to leave

    I'd ask her to fork out now. Otherwise it's not fair on you and she won't have the chance to learn from her mistakes. Make her pay now (somebody has to and you weren't EVEN having the good time!) and it's a valuable life learnt about the result of our actions on others as well as being socially aware.

    If you leave it now and she does something else next month ... what then? You need to set the precedent now of "pay up now"

    A deposit is something you take against problems at the END of a contract.
    If you were renting a house and the tenant left a tap on and ruined carpets etc then it would be up to the tenant to repair the damage they had done.

    So the same principle applies, you lodger needs to pay for the damage done now.

    As you are friends if she is short of cash today, then you could offer to pay out of your own pocket and she can refund you in full on pay day. If you want to use the deposit rather than your own account then that is your choice - it certainly shouldn't be your lodgers choice.

    Hi I personally would give her the choice BUT only because you say you are friends and you are living with her. I have left a tap running got talking to my girlfriend and flooded the bathroom whilst sober so it can happen.
    If it was a rental propert and the damage is not fare wear and tear the tenent is liable and can / should be invoiced at the time of the incident.

    If she is short of cash today she should have thought about having a booze up yesterday.
