I'm feeling so scared of bankruptcy

I don't have any ccj's.
CCCS have said i could make token payments to my creditors but this may not stop the phone calls, so i'd be better just saving up my money to afford to go bankrupt but I know this will take me sometime to raise the money.

If your reluctant to change your phone number, you could try writing to them. This is a template letter to send. It doesn't always work, but might ease the calls off a little.
Dear Sir / Madam,
Re accounts ref
I am writing to you to inform that I request all communications to me in writing. I do not want any further telephone calls made to me.
To continue to contact me by telephone after I have requested you not to constitutes harassment. I require all future communications in writing for future Court use. Do not telephone me again – remove any telephone numbers you hold for me from your systems.
Your telephone calls are in breach of the Office of Fair Trading guidelines. If you continue with them after the receipt of this letter, an official complaint, together with a log recording the times and frequency will be passed both to that office and to Trading Standards, For your information, all telephone calls are taped.
This type of debt collection method is contrary to the ‘Administration of Justice Act 1970’. In that it is intended to cause alarm and distress to the recipient. Your methods will not be tolerated. A formal complaint to the relevant authorities will be made.
Take further notice that continued telephone calls after receipt of a request not to call may constitute a criminal offence under Section 127 of the Communications Act 2003.
Communicate in writing and ONLY in writing. Your telephone calls will not be answered.
HOWEVER, CALLS WILL TRIGGER COMPLAINTS TO THE REGULATORY BODIES.

One thing as well if your with BT you can have a bar on any calls incoming that withold their number they'll usually do that for free...and if you send the letter BLTN kindly supplied give it a little time before you start to threaten contact with trading standards etc if they continue to hassle you

Presumably when they phone they ask you for "personal security details", I used to refuse to tell them .. why would I inform a stranger of my details?? .. and told them to write to me if they needed to contact me.

Rest assured your debts will not affect your dad unless you have anything joint? loans? if not then your ok...either way nobody will come to take anything away so try not to worry about that (I know easier said than done) i've worked in the PCT for many years with community based projects...talk to your social worker she might be able to come to court with you, she will be allowed to she'll not be able to advise you or go into court should you have to see the judge..if you do thats only 10mins or so anyhow..if not maybe someone from the CAB? or you could telephone the court and ask if they have a "support unit" thats someone that will help you through the day sit with you in court etc...not available everywhere though so depends where your planning to go to court....everyone here is with you every step of the way we'd all come with you if we could!

well done for having the courage to post both Mrs Bones and Marste. Facing up to the situation is probably one of the hardest things you will have to do and I just wanted to say that you have taken what might be the hardest step. I've not been on here for long but went bankrupt last week and the people on here are so friendly and helpful, if they can help they will. What's most important is that you look after yourself and take each step as it comes.

This is my experience but I hope it helps- I realised back in Dec 2007 bankruptcy was my only option( got advice from CCCS/National Debtline). I had to wait 2 months for a court date- I stopped payng my creditors and gave them £1 token payments and sent a copy of CCCS budget- this gave me a bit of breathing space.
It WAS hard, I got constant letters, phone calls (I unplugged the phone)- but I went bankrupt 2 months later.
I sent each of my creditors a copy of the bankruptcy order and have heard nothing since.
You may need to hold your nerve a couple of months- but do as I did- unplug the phone.
I have been bankrupt now for bout 3 months- you will NOT get bailiffs-unless you have £2k mega posh plasma screen TVs/ antiques/timeshares/herds of racehorses grazing in back garden- they (the OR) are not interested.
Please dont worry about the courts- I thought mine would be horrid- but they were actually really good- I never saw a Judge and the court staff were so kind. The OR was also really good.
I think-sometimes- we get so used to being harangued and bullied by DCAs we sometimes forget not everyone is like this.
If you need someone to cut through the c**p/separate fact from fiction- call one of the debt charities- one thing I have learned is NEVER believe anyone from a collections dept- they "lie through their back teeth".(is this a Yorkshire saying or does everyone use it??)0 -

In answer to some of your questions. I don't own a house or car and I don't have anything of high vaule. I'm currently having to live at home with my dad who is himself retired and not in the best of health, he has said he will support me with going bankrupt if I think thats what i want to do but he does not feel he'll be fit enought to come to the court with me. He was worried about baileifs comeing to the house and how it would affect him but CAB have said it will not affect him personaly, could someone please reasure me that this is true. I don't want to cause trouble for my dad or let him be in anyway responsiable for my debts.
I do have a primary care team social worker, i'v not thought of talking to her but I guess i could ask if she would come to court with me.

Have you contacted your local Social Services department or Council Department?
Some places have a befriending scheme, where volunteers will help you out and go shopping with you and things. If all you need is a little reassurance, I am sure your GP would set things up and help you out.
First thing I would do is ask your Social Worker - after all, this is a big thing you are going through and one that could possibly affect your Mental Health.
Don't worry about your Dad - ignore the 'phone calls and ignore the door. Ignorance is bliss.
Best advice I can give you is, don't worry. It is only money, they can't kill you... fu*k them:cool:0
