As this would have been a second visit then the fees should be just £18.00
The bailiff has sent the case back as Nulla Bono meaning NIL EFFECTS. In other words there are unsufficient goods available to cover the debt and their fees.
It is RARE that eanyone ever gets a custodial sentence. This statment by the bailiff is done for effect. In order to grant a prison sentence the court would have to PROVE that the reason for non payment is WILFUL REFUSAL AND CULPABLE NEGLECT. Clearly this does not apply to you.
However I would suggest that a letter is sent to the local authority to advise them that the debt is being returned as Nulla Bono by B&S and that you wish to make nominal repayment proposals etc. I have sent you a pm.0 -
I am going to contact he council before they contact me thats for sure. I am just worried because I cant offer them a lot. My business went bankrupt in Jan this year, my husband got a job, then got laid off but then got another job quickly, thank goodness.
We are literally starting all over again, we lost our business and our home, what I can offer them will probably be looked on by them as pitiful. I am worried they wont accept it and then there is only one option left for them which is the custodial one. It seems impossible that in this day and age for this to happen for a debt but the way my lucks gone lately you never know. I am trying to pluck up the courage to ring them today. Dee.
Oh by the way, question for a mate who hasnt got internet - they have an accident claim going on at the moment, if they go bankrupt and then later win their accident claim case can the O/R claim the money awarded? Thanks in advance from my mate David!!0 -

I think that if the claim is for injury only then the OR won't be interested but if a part of the claim is for loss of earnings or replacement property then the OR may well take an interest (whether he/she actually takes anything is a different matter though) ... i'm not 100% sure on this so best to wait for someone who knows
