    Hi Dee

Yes, the bailiffs can charge for unsuccessful visits - but they're wasting their time, since it will all be covered by your bankruptcy anyway! You do not have to let them into your home, they have no right of entry. Don't open the door to them, don't sign anything they give you - you might want to get a photocopy of your BR order to give them and send one to the Council, too, with a covering letter setting out the catalogue of errors they've made. Address it to the senior finance person - Director or Treasurer or whatever the title is (it's on anything the council have sent you re: CTax or business rates). Advise them that if they do not immediately withdraw the cases from the bailiffs, you will complain to the Local Government Ombudsman. Also, today, contact your local Councillor and get them involved - they are elected to represent you and HAVE to take these things up on your behalf.

I'm really angry that your local council are being such idiots about this, and even more so that your OR's officers seem so clueless!

Do keep posting, and don't cave in to these t***ers!!

Thanks for the support and advice, the trouble is I tell the bailiffs and the council they cant do this but they ignore me and say they can. They say if I do not let them in they can force entry. Because no-one in authority is backing me I have no 'defence' as such and I dont know how much more trouble I can get into because I have no knowledge or backup, its really hard.
I could write letters to the people you mention but the visit is imminent and I am probably out of time.

I've PM'd Herbie about this thread as they have a lot of knowledge with regards to bailiffs and might be able to help.
Might not but thought it was worth a try!

Cracking post as always Herbie! I like a fight, too!

Dee, do get your local Councillor involved - 17 years in local gov't and the only people who had any power at all in these situations were Councillors. I thought of them as pains, and some of them were overly nosey, but from your standpoint their involvement could put a full stop to a lot of stress. I really would also say that a letter to the head honcho (if you give me your location I'll PM you the details and draft a letter for you if that would help?) threatening a complaint to the LGO could start some cages rattling. Then of course, there's always your MP - Chief Exec's of councils quake at the sight of House of Commons headed paper!!

Good idea, thanks. Yes, I am ringing my MP's office tomorrow to get an appointment with him. When all the trouble kicked off at the pub with the pubco, cant mention their names for legal reasons, my MP was brilliant. He sent an email of support which he allowed me to use publicly on my website and he came out to visit us and spoke to the local press. So, he is a very helpful gentlemen. Dee.

    Dee,
Have you let him in before? If not DO NOT LET HIM IN, he has no right to force entry. Keep your doors and windows locked and talk to him through the letter box, if you have to talk to him at all.

However, if you have let him in before he does have the right to break a window to get in.

They came, were here 5 mins and decided there was nothing worth taking, I told them this weeks ago. Of course a charge for them coming out will be added to the debt. They said it will go back to the council who may consider a custodial order, i guess I will just have to wait and see what happens.

Thanks for everyones help, you have been amazing, especially those of you who have pmd me with info and advice. This forum is ace, I wish id found it earlier!!

    Dee.
