My bankruptcy

I went bankrupt in jan this year. We have been through a difficult time for 18 months with our business and it went bust. I have my meeting with OR next week - have missed 3 appointments, 1 they sent my appointment to the wrong address, 2nd time I had no money I have to travel approx 30 miles on public transport to get there and i simply had no money at all. Third time a death in the family. Obviously if I dont make this apppintment im in trouble so come hell or high water I will be there.

Very worried about it all and just found out that a debt I had is not covered by the bankruptcy so i am awaiting the bailiffs to come and take my furniture, thats all i have left for them to take!!

I will be glad when this is all over and the bankruptcy is done with and mainly when the bailiffs are finally off my back.

I was, and once again thank god, a very strong person, it scares me to think how all of this made me feel - scared, paranoid, sick etc. A less strong person may not of made it through. I do know, though when its all over and I have licked my wounds - I want to help other people going through this.

    Hi and welcome.
    Can i ask what was not covered by bc as i am sure that apart from student loans pretty much all else is covered?.

    Hi Dee,

    Good to see you & welcome aboard. Sounds like you have had a tough time...as Dalip says I would be interested in what debt is not in your BR . I did not think student loan people would do the baliff thing but I don`t really know...that sounds horrendous!!

    You`ve come to the right place for support & help ..its also so good that you would like to help others...your experience is invaluable in offering life experience to those who find themselves in the misery of debt! You sound like a strong person & your journey will have made you stronger even though it may not seem that way straight away.

    Court fines, debts due to CSA, awards for damages and fraud are a few other debts not included in BR.

    business rates & council tax liability order that was granted by the court before the bankruptcy happened.

    And thanks for the replies of support, it has been very hard. We lost our dream, our business and our owned home, its all gone. I have been through the feelings of fear, confusion, embarassement etc. My husband & I have been through all of this together but it was a sole trading company in my name only and I felt very responsible for what happened. It was my idea in the first place and do i feel that!!

    It is tremendous to have a site like this available to people, what a great resource and also you realise you are not alone, lonely is another way I felt for a while. Dee.

    Dee you are at the bottom now, the only way is up,look to the future,put the past behind you. I know it's easier said than done. You have lost your home,bussiness,debts and dreams. You have each other. All the other things are material,they would be wortless with out your OH.

    There will be other dreams trust me and you have your OH to share those dreams with.

    Just remember you still have each other.D

    Hi Dee and welcome!

    As some people may know, I was a CTax recovery officer for over a decade, during which time I also recovered unpaid business rates and I can tell you that both ARE msot definitely covered by Bankruptcy. My Council would never have permitted it, but some Councils and most DCA/Bailiff firms retained by Councils, will tell you anything to get you to pay at least something off the debt - don't forget that with a DCA or Bailiff, the first couple of hundred pounds you pay simply covers their costs! Report these debts to your OR who will notify them in writing - although they generally write to local authorities as a matter of course just in case someone's forgotten to mention this type of debt, even if it's not on their petition form.

    Thanks for that Dalipo , i know I am very lucky to be in such a strong marriage, I do count my blessings and compared to some poor folks out there I have many!

    Jude, I spoke to the OR and the council and the bailiff company can do this. My local CAB spent 3 hours trying to stop the bailiff action by speaking to the council and the bailiff company on my behalf, all to no avail. The council insist the action has gone too far to stop and the bailiff say they cant stop it unless the council tell them too. They can have whats left of my stuff, we have moved from a 3 bedroom, to a 2 bedroom and now to a 1 bedrrom place so as you can imagine theres not much left, we couldnt fit it in!! Dee.

    Try going to a higher person in the OR office. We recently had a couple of cases where the op had to tell the OR that they were wrong. Won't hurt not sure but you can ask to speak to the actual OR not just one of his/her assistents,who would have delt with your case so far. Maybe fermi could help with this.
