Firstly Hi everyone its my first posting..
Can anyone tell me if a company can legally refuse to provide proof of No Claims Discount.
I recently had a policy with Swiftcover.
I was quoted a price of 170 for a 51plate Chrysler Cruiser 2 litre
paying monthly was about 18 quid
I was late sending them proof of NCB as i was waiting for it from prevoius insurers.
They put up cost to about 61 per month.until i sent NCB then it went down to 18 again, however i had paid 2 months at 61.
Due to circumstances i sold the Chrysler and bought a 1.4 Rover, after Mot was failed with flying colours:rolleyes: i now have an old Mreg Ford escort 1.3
I have paid Swiftcover a total of over 220 and they say i still owe 99 pound.
They are refusing to provide proof of NCB till this is paid.
So they are expecting me to pay 320 for a 170 policy.
My new insurer (Swinton Collonade) are threatening to cancel my policy within 7 days if they dont receive the NCB
Any helpful suggestions gratefully received.

Sounds as though you owe them money so don't blame them not giving you NCD confirmation... Sure they will have charged you each time you changed cars and each car I am sure will have been a different insurance risk so a different premium...

Yes i understand about the change of vehicles although i personally dont think the last 2 cars would be dearer than the first, they are lower insurance groups.
Swiftcover are also saying that i have to pay full price for the time they didnt have the NCD proof.
But with over 6 years NCD i cannot lose this without making a claim and then it is miraculously reappearing. The NCD surely is valid continously.
Can they actually withhold the proof of NCD legally?0 -
You owe them money... think they may have the legal system on their side... but I am no legal expert... :rolleyes:

Yes, they can legally withhold NCD proof. You owe them money, why should they do anything else for you until it is clear?

No they can't legally withhold bonus proof, they will try too and in my opinion should be allowed too if monies are outstanding but they cannot legally do so.0 -

Yes they can. I work in insurance and indeed have seen complaints of this nature, it's fine to withhold proof. Under what principle of law would it be 'illegal' to withhold proof?0 -

No they can't, I work in insurance too and it's not fine to withhold it. I would suggest you have a look on the ABI website.0 -

Whereabouts? Because when a colleague of mine phoned the FOS technical advice line, they informed him it was fine to withhold it - as long as a clause regarding withholding proof was stipulated in the policy documents.
Edited to add, a search of the ABI website for 'No claims discount' doesn't give any relevant hits apart from this one (an obsolete document anyway as it is dated 23/02/1999)

"Written evidence, such as proof of no claims discount, must not be withheld from the client by way of a lien unless the client is advised of this in writing and given adequate and justifiable reasons for the action taken."

I do not understand how it took you two months to get NCB proof from previous company? Nevertheless, I would suggest that Swiftcover ought to credit you for those 2 months where you overpaid, however they will have charged you an admin fee for the two car changes. Still your figures do not seem to add up. I would ask for a written statement of account and if you are not satisfied I would make a formal complaint.
