Mis-sold 18 mth contract by upgrades direct. Company out of business.
I used to get companys cold calling me trying to sell me mobile contracts and always declined. But one day I was caught off guard while at my work and actually entered into a conversation with someone and told them I still had a few months to go. He basically seduced me with what I thought was a good deal at the time. He agreed to pay off my last few months contract with T mobile, send me a new phone with 3. The contract was for 12 mths with 6 mths 1/2 line rental. I agreed to let him send me the phone, thinking whats the worst that could happen? I can always send it back if it's dodgy.
Phone arrived everything seemed fine. Along with the phone was a return bag and sim. I didn't actually realise it at the time but I never received a contract, liked the phone so kept it and started to use it. A few days later got my Direct Debit confirmation letter from 3. The letter was addressed to me and had my bank details on it but the Bank account name was not mine. I started to get a wee bit worried. So I called 3 and confirmed the information they had on my account. I was told the only thing that was wrong was the account name. She confirmed my half price line rental for first 6 mths, length of my contract etc. I was so relieved everthing was in order. The only thing I hadnt recd was the information to claim my last 3 mths contract with T mobile.
So, I phoned and emailed upgrades direct various times with no reply. I finally gave up putting it down to experience thinking everything else was sorted.
That was until my 12 months expired and I called 3 for a new deal. And thats when I was told I wasnt entited to one as my contract was not at its end. My contract was apparently for 18 mths totally contradicting what the first lady from 3 told me. I didnt panic but both myself and 3 tried to contact the company to sort it out but since I took out the contract the company have vanished of the face of the earth.
Since then 3 have washed their hands of it, refusing to let me cancel untill the 18mths finished in April and have now employed a debt collection company "Direct Legal Collection" to hound me.
I thought if 3 sent me a copy of my contract I could take it to a lawyer for advice. But they no longer reply to my emails and calling them has been a waste of time (make me think they have nothing to send me!). I could not tell you the amount of wasted phone calls I have made to call centres, the language barrier is awful.

I stopped using that phone 14mths into the contract and paid everthing up to date at that time. I am being chased for the other 4 months line rental which is just over £100. I just dont have this sort of money to waste and am very stubborn, why should I pay it. Surely a large company like 3 should waive this charge under the circumstances. I cant take it any more and have taken to not answering the phone to DLC.
And I know its not the solution.

If anyone thinks they could help I would be so grateful. I promise not to give in to cold calling every again!
