protect other buyers from this seller's ignorance/stupidity
within 12 months the neg will clear off their %age score0 -
we bought summat for 99p very poor condition not as described , £4 packaging , seller says what do we exepct for 99p

i sold an item on ebay the winner did not purchase and threatened to leave me neg feedback if i left him neg feedback, i left the neg fb and so did he stating sob and mf when i complained to ebay they refunded me the costs but said that the do not take anything to do with feeback even when i told them what the letters stood for (sob & mf) ebay dont care as long as they get your money0

I agree with the OP completely, refund should be given and open a dispute.
However did the listing have a picture of the shoes? If so, were you able to tell the condition. If so, perhaps you should of questioned whether they really were new, i myself have doubted some listings and have just contacted the seller to double check if something is new or what new means to them.
