Someone copied my listing !

I was just browsing ebay and noticed someone has copied completely a listing I had on there last week.

The have copied all of the description, even used my photos.

In fact, they have not changed anything at all :mad:

Do I have the right to ask ebay to remove this listing ?

Looking through their questions and answers..all I can find is something about property rights and having to prove intellectual property rights...or something like that :confused:

    By copying your listing they're indeed breaking copyright laws. I should think you will be able to e-mail eBay, giving them the link to the seller's listing and that of your own listing posted a week ago, and they should do something about this, by either removing the listing or disciplining the seller.

    You could also try e-mailing the seller themselves and make them aware that copying written material is illegal and as you're the owner you would like them to change the material or (a very long shot) pay an amount to you for use of the material.

    Either way you're in the right and they're in the wrong, unless of course you took the material yourself of a website. :rotfl:

  • I wrote everything myself....took me ages !

    That's the annoying thing about it, they didn't even bother to change the text size / colour / font / layout.

    They even used my photo's taken in the lounge.

    I wouldn't have been so annoyed had they made an effort and changed things around as bit.

  • Well then you're the owner of all the material on the auction and so they have infringed the copyright laws. Send eBay an e-mail or like I say ask the seller politely yourself to make changes.

    Is it for a "single" item that you have already sold ? - if so , personally I would say don't fret, no real harm done

    no..they were hosted on ebay.

    lol... yep, that certainly is a good idea. :)

    It is anoying when someone rips off your pix or listing, but if its not something you are selling on a regular basis and thus the person is a competitor, then i wouldnt worry about it.

    i think i would agree here.

    i know it can be annoying, especially when they nick a picture which has your cat in the background or something!

    it just seems that some people are too lazy to take their own pictures or find them on the net.

    the person was probably watching your listing to see how much i went for and if it was worth selling their own.

    i personally watch other peoples listings to see how much things i own are worth but would never copy descriptions, its quite simple to do them yourself.

    I had one that even included a link to my "ME page" for payment instructions-
    unfortunately I did not get his money, although he got more for the phone than I did !
