Help me - Phones4U contract -Cancel?

My friend went shopping around for phones on contract today and ended up getting one from Phones4U. She wasn't really convinced but she said they practically made it impossible for her to leave and has a phone and contract she doesn't want.

I've convinced her that she does have rights and I'll go with her tomorrow to return the phone/cancel contract. The phone is OK, but the contract is S**T and shes going to go with O2 online and get the same phone, better deal.

She was given £50 cash there and then and stupidly also took out the insurance. She has had the phone out of the box but hasn't made any calls, texts etc..... and still has the paperwork.

When I go with her tomorrow is there anything I should/shouldn't say. She def doesn't want to go with phones4u, nothing will change her mind on that, but I'm gearing up for some hard sales pitch! Silly question, but I've mystery shopped P4U before and I'm sure they shouldn't be giving cash out there and then!

Am I right in thinking that this should be straightforward and no problems, etc.....

You have no statutory cooling off rights when you sign up in store (unlike when you buy on line).

So check the contract carefully to find out if you are allowed to now cancel.

There is no reason why they shouldn't give her £50 as a reward.
  • No statutory rights - you're joking? Surely if the phone's going back less than 24 hours after signing up then there are some rights? Uh oh. . . .

this would be straight forward and u can cancel as long as ur in ur 14 days and also the phone is in the condition that it was given to u in ....like no scratches on the phone or parts of the box missing

They will return it to u ...and the 50 quid was probably to make the line rental cheaper for 10 months and then she can downgrade her tariff to what she likes ....

to be honest why go into a phone shop, sit down, be with a consultant for 20 mins if u dont need a phone, or why do that then go buy online

OR even better take the phone and then say ah i was forced into it, no u were probably convinced into it because it had many benefits which the person let u know and u took it at the time and then someone comes and says AAAAAAAAAA thats such a bad deal and then makes u get another one which is same but its apparently better because u got 100 more txt which u wont use .....

PS. it does not effect your statuory rights ....the only way they wont do it is if its on 3 or if its an upgrade ...the rest they will have to do. Also the fact she bought it withb P4u doesnt mean its viv p4u its actually still with o2, CPW's o2 is not the same as normal o2 but p4u's is same ....and the cash yeh mate they do give cash there and then depends on what deal and phone u get ....for example u can get 200 quid on t mobile 800 mins unlimited txt for 35 quid only catch is that u get the J700 with it ....

If it was me I'd have done my research properly, but my best friend is not so good! My friend went into P4U to see what they could offer, she also went into CPW and O2 store prior to this. She said that P4U were pushing her alot and in the end just signed up. I know the staff work hard and having mystery shopped them - after an hour and twenty mins they were still practically stopping me walking out of the door without a sale. I shall go with her tomorrow to return the phone - hopefully without any problems. Thank you for your advice - although I can't help but wonder if it is touch sarcastic but I know what you mean - ;)
