    Hello,

Can you tell me how to go about claiming?

    many thanks
  • Sorry Dicklad, are you looking to claim for an unenforceable/voidable loan, or is your query to do with payment protection insurance?

If its PPI, there is a discussion thread at the top of this board. There are a lot of knowledgeable people there who can help. Also look at Martin's guide, and use the template letters.

If its unenforceable/voidable, there are companies who can help. I don't know if its a DIY job - I'd rather pay someone who knows more about contract law, etc, than do it myself.
LBM November 2005: approx £32K
    Current debt: approx £12K :T

Thanks for your reply. I am looking to claim for an unenforceable loan. Do you know any companies that do this? And does anyone know how much i could get back from a loan of 15k?

    Many thanks folks

    Good Morning Homer.

Just as an example, if a person was to go for an unenforceable loan claim, what sort of compensation figure would be expected?

    Many Thanks
  • Hi there,

Might be worth a listen on "BBC I player" to an article on the issue of unenforceable loans on the above show. It certainly caught my interest. it looks like an issue that has been hanging around for a little while but not yet taken up in earnest by many. Internet searches show a couple of companies looking to make a business out of it and others getting ready to. It would be good if Martin made a bit of a holding statement on it whilst his team investigate further.
  • hi finleys_Dad,
i agree with you it would be nice to know if anyone has used these companies and what the outcome was, i sent off all the details of my problem to one two weeks ago, have not heard anything yet, but on their website it does clearly say that the only money you pay is £10 for the sar whether you win or lose the case, otherwise i could not afford to take on the big boys, i think that is what they expect most of the time, i will keep in touch when i hear something, thanks

  • This is a very interesting subject and one which I am trying to do something with at the moment. I have a couple of accounts which either have no credit agreement or they are trying to get away with an application form. I would be interested in finding someone to take this on for me as I really do think it is beyond my capabilities but the only company I can find at the moment is one that wants £250.00 up front. Obviously not going to pay that!!

No, don't. Absolutely all the credible advice given on the forum warns against companies who charge upfront. There are many many reports of people who have done so; their claim (on a no win, no fee basis) has failed and they have not been able to get their money back.

There's plenty to this effect on the Mortgages and Endowments board.

Not all tho as I know somebody who did pay and they won. I think it's up to the individual who you decide to use.
