    Very suspicious - to upgrade an account you need an account in the first place, and if the OP's partner was forever being asked about the upgrade why would they bother going into the bank if they were not either paying in or taking out?

    Define a troll please, some twa*t called me one on the Mortgages forum a couple of weeks ago because they chose not read my post correctly.

    To be fair to our Man Utd supporter he makes some valid points.

    There are inconsistencies in the post made by the OP and in the event of a formal complaint, if that was the wording used, the bank could choose to use in their favour. If it went to the FOS they certainly would.

    It is very easy to knock the banks and insurers. Sometimes for good reason. Other times not. There are a enough question marks in the OP's post to suggest that we are not getting the full story.

    I don't understand the sly remarks. I am very grateful for the helpful suggestions but I don't know why some people are so quick to judge. Why would I lie about it? I admit that my partner did make mistakes. Number 1, he probably shouldn't have been taken in by the bank clerk but when you have no money & someone is offering you credit cards & overdrafts it is easy to get taken in. Number 2, he should have been more insistent on the day he received the card & asked her to close the account, but he was under the impression it was free for 90 days so he didn't think there was any rush to close the account & allowed himself to be fobbed off. He has let it drag on for too long but as I said the branch staff aren't interested while the account is overdrawn & neither are the lending centre they just want offers to pay, so he has been passed from one to another. He keeps being referred back to the branch that opened the account. It is only a small branch with one person on customer enquiries it is the same person everyday this person is Lisa, she is the assistant manager at Tamworth branch & she is the one that opened the account. She obviously doesn't want to admit she is wrong so she just says "I can't do anything because the account is too far overdrawn & I cannot cancel charges. Call the lending centre they deal with overdrawn accounts". It's a waste of time even going in there.
    I just really wanted some advice because whatever happened I feel he was mis-sold the account, he was told there was a 90 day trial period during which time he would not be charged for the account, this was a lie. I have the statements in front of me & can provide full details of dates & charges to anyone who doubts what I'm saying. He hasn't had any money paid into this account or withdrawn any money the amount owing is 100% bank fees, charges & interest. During this time he has continued to use his basic step account to receive his benefit & pay bills. I am not educated & therefore my wording may not be very good but I have tried to put things as clearly as possible, if this has caused confusion then I apologise. Obviously when making a formal complaint to the bank or FSA the details will be written properly by someone who knows how to word things. But to be honest it doesn't matter what you think I know the truth of the matter, my partner has all the paperwork to prove it so it's just a matter of trying to get Natwest to admit they are in the wrong. Even the man at the Natwest call centre said the branch are wrong, Lisa the bank clerk knew he was on benefits so she should never have offered him a gold account. She should also have explained that he had to pay the £12 a month fees during the initial 90 day trial period & then they will be refunded later if he changed his mind but she just said it's free for 90 days.
    Thanks to all the people who have given words of support & useful advice, keep up the good work. It seems a shame that the people who have posted on thousands of threads are the ones who have nothing nice to say. To all you tw*ts who have nothing better to do than make sly comments either tell me what you think these inconsistencies are so I can try to explain better or GO SUCK A FAT ONE.

    If the account truly had been upgraded rather than a new one set up then all this would probably have been avoided. There would have been £12 in the account to cover the charge thus no overdraft fees and interest. The OP's OH could then have cancelled within 90 days and got back the £12s.

    Is it normal practice for an upgrade to instead turn out to be a separate account?

    Why should he pay it off he hasn't had any money from them? He has never used this account. The account is £315 overdrawn which as I have said is made up of the £12 monthly fees + bank charges for not having any funds to cover the fees + interest. He has never paid into or withdrawn anything from this account. He was on income support because he had a bad fall but he is now looking for work. if he's on benefit or earning a million pound I don't think he should pay them a penny. As someone said the whole debt stems from a £12 fee that was levied against the account during a supposed 90 day free trial.
