Think I didnt word my post correctly.
He fitted it himself to his wall, using now special fittings. Just attaching it to the wall (using a bit of wood if I remember correctly).
Tv then fell off the wall and stopped working.
Man goes back to shop and says 'it doesnt work'. They soon found out it wasnt working because it broke after falling off the wall.
There is no way the SOGA should cover that.

To be honest it wasnt shown in that article but this happened a few months ago, as Ive seen it in other places. Plus got told about it from my old boss (comet manager).

Yes, if it was faulty already. Can't recall how long he'd had it (presumably it's in the article), but an inherent fault is an inherent fault. There'd obviously be doubt about whether it was faulty or whether he ahd damaged it during installation but dependant on how long he'd had it, the responsibility to prove this would be on the company (up to 6 months) or him (after 6 months)

Doesn't seem to say which Comet it was, but neither of them in Blackpool have helpful informed staff anyway. Paying £300+ for insurance would have covered accidental damage I'd have thought. This is quite clearly accidental damage, and it's not unreasonable for a consumer to get aggrieved (albeit not perhaps resorting to criminal damage), when the scummy scumbag scum salesman who sold him the overpriced warranty turns out to have been lying when he said it covered accidental damage.
I have claimed on three insurance policies in my life, once they made ridiculous demands to pay my £50 claim, and I gave up, another time they contradicted their own policy wording and initially told me I wasn't covered, and only once have I been paid out properly.0 -

I don't think insurance for accidental damage should cover EVERYTHING - if the TV wasn't installed correctly and fell off the wall, why should the insurance company pay up?
That would just put up premiums for those of us who actually use their brains.0 -

I dont care how he was treated he should not have smashed up the tv sets the bloke sounds like a right thug to me. A Nice sign and a bit of pacing to and fro outside the shop entrance would have been much more acceptable if you ask me. Customers in the shop must have been terrified0
