This is definitely not correct (and contradicted in stuck's next post, which states that the OP is liable if they are still living there).
The OP has lived with the claimant in the knowledge that she has been claiming as a single parent. They will have no doubt have also benefitted from the money at some point, even if not directly. In the eyes of the law, he is as culpable as she is.
