Cancellation rights!?! Confused

HI,

wonder if anyone can help me :confused:

My brother got a new mobile on a contract with orange on wednesday (from the shop , not online or on th phone ect).
The phone he choose is not very good so he thought he could go and exchange it for a different one. Not cancel the contract just get another phone.

They said that this was not possible so no he is stuck with a phone that is no good.

I would have though there was a period where you could return it like you have with most items you buy.

Am i wrong?
Any help would be great

    If you mean "not very good" i.e. it doesn't work, then YES they have to repair or replace it.

    If you mean "not very good" i.e. he made a poor choice and doesn't like it, then NO they don't. And nor does any other retailer in the same circumstances.

    He would have had a right of exchange had he bought online, as distance selling would have applied.

    I took this to mean something similar to distance selling rights. I was attempting to point out that that only applies to distance sales (online and mail order). :rolleyes:
