im going bankrupt in scotland new law out April 2008

hi all,
I hope you all dont mind I am going to write a blog here on my bakruptcy. I hope you find it interesting as I never seen to be able to find SCOTTISH BANKRUPTCY on here.
Here goes (the nerves have set in)
On the 1st of May I was told by the citizens advice that in Scotland you can file for bankprutcy yourself.(a creditor had to file in past) :T The Law changed here in April 2008
I was also told I could use the new law LILA (LOW INCOME LOW ASSETTS) The fee would be £100:j
I have been waiting for 2 years to try to get one of my creditors to file for me without any joy.
The lady at the citizens advice filled in all my forms took my £100 ,I dont have a cheque book they wrote me a cheque and off my forms went in the post on the 7th of May.
HUGE SIGH OF RELIEF.
The bankruptcy in SCOTLAND is dealt with an Administrator NO COURT APPEARANCE :T HUGE RELIEF :T :T :T :T
SO NOW I SIT WAITING FOR THE POST TO SEE MY BANKRUPTCY HAS GONE THROUGH. I'm not sure what is worse the waiting for the Bankruptcy of getting the bills in the post
I will keep you all updated as I do or know anything.
By the way I love this site it has helped me get things straight in my mind when I can't sleep.

hi all,
Forgot to say I've stopped all my direct debits stopped using my bank of scotland bank account and opened a coop cashminder. I know some of you said all us bankrupts to be should wait till after, but my nerves got the better of me.
I wont know I'm bankrupt till I get a letter in post it's not the same posting off paperwork to an Administrator as when you are actually in court and you know there and then you are bankrupt . I may well be sat here bankrupt and wont even know till I get my letter.
The sleepless night are setting (sorry if I ramble Im a single mum whos family live 550 miles away in England so you will probably have to put up with me and my nerves)
I hope there are other scottish bankrupts or bankrupts to be out there to let me know how they get on.

i will keep you all informed as to what happens and when. It all seems like a waiting game just now.
just got to say thanks to the lovely lady at the citizens advice she filled in the forms for me and sorted a cheque for me this made my life easier.
I am worried sick but i live on the lovely isle of lewis the sun is shining :j and i can see the sea n beach from my bedroom window so i think Im so lucky.
The bad side is we had a somerfeild (just closed) and a coop supermarket and the coop is putting prices up high 5 pence on all loose cooked meats ect ect ect :eek: :eek: :eek: OUTRAGEOUS . But the sommerfeild is being turned into TESCO :T :T :T so I hope we have mainland prices in there. Also we have HIGH petrol £1.19 per litre unleaded:eek: and it is a 12 mile round trip to the shop.
But I should nt complain it is lovely here in summer.

Thanks, Lou for this post.:T I have a friend who is contemplating bankruptcy via the LILA scheme but has a number of worries about the process...it will be interesting to see how you get on. Do you have a meeting arranged with the accountant in bankruptcy yet? This is the bit my friend is most worried about.:o Have you been asked about how you managed to get into debt?

The Insolvency Register doesn't keep details of any insolvencies in Scotland or Northern Ireland. I don't think there's an online register for those, but if you want details of bankruptcies in those areas you can contact:

I HAVE NO APPOINTMENT , not sure if i'll get a face to face one I live on an island not sure they have one here! or if ill get one at all.
i have sent off my application form. Then i will be sent another form for my income and outgoings (my statement of affairs) I have 21 days to fill this in and return it, this is what I am told by the citizens advice.
They also said she will probably be appointed as my trustee (like an OR I THINK DONT QUOTE ME ON THAT IM STILL UNSURE ABOUT IT ALL TILL IT HAPPENS) I hope its her she has been very nice so far!

LILA is the route into bankruptcy for people who have low income and low assets.
Low income means gross weekly income of no more than the standard national minimum wage for a forty hour working week. This is equivalent to £220.80 a week. Any pensions or maintenance payments that you receive are also counted in with your income.
If you receive income support, income-based jobseekers' allowance or working tax credits you will be treated as meeting the low income test, even if your actual income is more than £220.80 a week.
When calculating your income no account will be taken of other social security benefits or tax credits you receive or any income paid to another member of your family. However, your income, pensions, maintenance payments, benefits, tax credits and the income of other family members may be taken into account when considering whether you should pay a contribution while you are bankrupt.
Low assets means that you have no single asset worth more than £1,000 and your total assets are not worth more than £10,000. In addition, it means that you must not own or jointly own a house or any other property or land.lots of small stepswill get you a long waybsc 1400
