im going bankrupt in scotland new law out April 2008

    today a lovely lady at the aib rang me unexpectedly.

    Last week i recieved a letter trom social fund loan department telling me I was behind with payments. I sent them off a copy of my bankruptcy and sent the letter to the aib, this was meant to be included in the bankruptcy.

    Today the aib rang me and they were lovely not what i expected at all.
    They rang to tell me the social fund loan will be added to the bankruptcy but i must be aware as it is from the goverment they can after iam discharged ask me to pay it back. Im not sure if that seems fair one rule for one for the goverment. Dont get me wrong i am willing to pay this back it just seems so strange to put it in the bankruptcy and still have to pay it.

    Anyway while she was on phone I asked her if i would be getting an interview and she said maybe you will maybe you wont but it is most likely that in 6 months you will just recived a letter asking if your income or circumstances have changed. I told her they would as my son is 16 and going in the army my income will go down. she said they will only be interested in if it goes up for example if i win the pools (if only)
    So as far as I am aware that is it for me NO INTERVIEW so I wont worry about this so much now.
    And i still get to keep my car HOORAY! so I can begin to build my life again.

    MY new life is beginning
    I now have a car I owe nothing on so I can keep my job:j
    I have a prepaid credit card I am saving up on for emergencies and holidays:T
    I have a new kitten aarrrggggh sooooo cute:p
    I am feeling like this is the beginning of my new life
    Iam now sticking to my budget:j

    Oh yes and I have started doing the competitions on here and I won my first one a breastfeeding cape which will be a presant for my pregnant sister in law so saved money on buying them a gift:T
    So heres to a new life :beer:

    how many years of financial affairs did you have to provide? properties sold in the xx many years, bank account numbers in the last xx many years etc?

    i didnt have to provide any years financial affairs .i applied for bankruptcy using the scottish new law (low income low assets) I had to provide a list of creditors and tell them which benefits i recieve (working tax credit and child tax credit )
    I also had to be earning the equivalent of minimum wage for a 40 hour week or less .I work 20 hours on minimum wage so that was less.
    I only provided my open bank accounts not closed ones never asked for closed ones.
    I did have to tell them if i had ever owned a house/ property which i havent

    Yes i feel very lucky but I will tell you it has made me a much more sensible shopper ,budgeter and I am even trying hard to have an emergency fund something I couldnt dream of before.

    Did they ever ask you for a SOA? Im worried my income may look high to them as I get over 1k a month, but that mostly goes on childcare...

    Hi LouLou, glas things seem to have went as smoothly as they can for having to become bankrupt. I am in Scotland and the CAB have told me my best bet would be to declare myself bankrupt. Only problem there is I can't afford the £100 they want when I send the forms. I am not working so have no chance of getting that amount of money anytime soon. I am in a catch22 it would seem.

    Are you still paying off your debts? If you are stop now and save that money towards your fees. The only things you should be paying are your priority bills rent/mortgage. gas/electric, water, council tax and housekeeping.

    No I haven't paid anything since April/May. I will need a wee win on the lottery to get the money together methinks. 4 numbers coming up would help me on my way. Of course all 6 coming up would be even better.

    No they havent so far they did get a piece of paper that i scribble ddown my income and outgoings very roughly for the citizens advice ( I didnt know they had sent this until the administrator told me on the phone. They dont seem to be interested in a soa as I applied by the lila route and this tells them I have no money spare

    That is very unfortunate.
    Is it possible for you to stop paying a debt (that is if you are just know) and use this money for the bankruptcy
    If not have a look on the internet i have heard that some charity will help with the fee although i,m not sure which ones.
