A LETTER ARRIVES.
SATURDAY a letter arrived from the AIB. It is a "Statuory Declaration" for me to fill in. I have 21 days to fill it in and return it or my bankruptcy will be refused and they would keep my fee. Guess what it will be in post in Monday morning.
The part for me to fill in seams to be uneccessarry paperwork as i have answered these questions on the br application form.
This form is to check im entitled to apply for the low income low assets route.(lila)
This is what is on my form
BOXES TO TICK
1. IAM IN RECEIPT OF INCOME SUPPORT, INCOME-BASED JOBSEEKERS' ALLOWANCE, WORKING TAX CREDIT, HOUSING BENEFIT, OR COUNCIL TAX BENEFIT.
2.MY WEEKLY INCOME BEFORE TAX DOES NOT EXCEED THE STANDARD NATIONAL MINIMUM WAGE FOR A 40 HOUR WORKING WEEK (CURRENTLY £220.80)
3. I DO NOT HAVE ANY NON-EXEMPT ASSETS WORTH MORE THAN £1,000
4. THE TOTAL VALUE OF MY NON_EXEMPT ASSETS IS NOT MORE THAN £10,000
5. I DO NOT OWN OR JOINTLY OWN A HOUSE OR ANY OTHER HERITABLE PROPERTY.
I am able to tick all these boxes, I hope, my bankruptcy will be straight forward.
There is a warning it is a criminal offence to make a false declaration puishment is £5000 or prison or both:eek: i wouldnt dare
well this does seem to be taking a long time but im getting there one step at a time,
I have stopped worrying about it so much, as however slowly things are progressing at least there is light at the end of the tunnel.
I hope this information helps put some of you scottish peoples mind at rest and hope it is interesting to the rest ot you.so im waiting still to be bakrupt and will keep you all informed

yes i had to fill this in on the application and then in a separate statement that came in the post before they would grant the bankruptcy. Good news about the car:T Just wondered if you have had OR/AIB interview yet or contact from them re. a future interview? It's now 3 weeks since my friend sent back her forms but no notification of bankruptcy/sequestration as yet.

I haven't been on this site for a while but I moved to scotland last year with hubby and 3 kids and have been trying to sort out what our next move is since our house in England has become the route to our downfall.
I have just printed out debtor application pack for me under LILA but your info on CAB has been very useful. I have spoken to many people on the phone but never managed to get a face to face appointment. Do you think it is worth filling the form in with them?
Our house down south is being repossessed and then they will come after us for the surplus at which point we are hoping my hubby will be chased and able to go bankrupt.
Re the register - there is alink on the AIB website to it - haven't been on it cos I think you have to register and I didn't see the point as yet but see how you get on.
Can you tell me what they allowed you for reasonable living expenses? I don't see how we have any surplus to pay but someone said we would have to pay about £200 per month - i work out we only have £150 per week for food, dentist, clothes, petrol etc so where do they get the idea we would have £200 extra?0 -

Dont worry - your not stupid and this isnt that historical, Lou replied to me on it yesterday! Im sure she will help you if she can. I am doing scottich banckrupcy too. And as far as I can see, if you only have £150 for food e.t.c each week, you wouldnt have to pay £200 a month! You are allowed reasobale amount, if you have kids that is quite dramatically increased, it really depends on you incoming and outgoing (obviously excluding all your debt that you currently pay, if any) If you start your own thread here, with an ide of your incoming and out going, we should be able to give you an idea of what our impressions are! you dont have to register to use the AIB website, unless I read that totally wrong, the address is; http://www.aib.gov.uk/ you could try ringing these people http://www.scottishdebtadvice.com/ and they will help you work out what is best.Bankruptcy Supporters Club No.1790 -
Ive still not heard anything about an interview in a way i wish they would do one so it is over and done with. I have had no letter so far other than the letter telling me Im bankrupt its been 5 weeks now and nothing.Eternal_Optimist wrote: »Hi Lou:D

I hope your friend is feeling better for having the courage to go bankrupt it is a major thing. I'll keep you informed if I receive a letter or anything from the aib about an interview.

ARE YOU SURE WE HAVE AN INTERVIEW IN SCOTLAND WITH THE OR/AIB?
WE'VE HAD A MEETING ABOUT 2 WEEKS AGO WITH THE INSOLVENCY PRACTIONERS COMPANY CCCS GOT TO HELP US DO OUR PAPERWORK.....THEY ARE NOW OUR TRUSTEE. WE'VE SIGNED THE DIRECT DEBIT FOR 3 YRS PAYMENTS WHICH WILL BE REVIEWED EVERY 6 MONTHS...THE HOUSE WAS SURVEYED ABOUT THE SAME TIME......STILL TO FIND OUT HOW MUCH THE BI IS.......HOPEFULLY NOT A LOT , AS MY MUM IS GOING TO PAY THIS.

Supposedly they're less serious than bankruptcy but I am absolutely sh**ting myself regardless.
Like you I have found the citizen's advice really helpful and hats off to them, they really are great.
Hope your bankruptcy is through and you can sleep at night, I am looking forward to catching up on lost sleep when mine is all sorted
