BIL divorced without knowledge?

BIL works shifts as he is a cabby. When he receives the post is really a luck of the draw as to whether he is at home or not. As Slapa has been through a previous divorce, she knew the procedure.
He's happy to be rid of her now, but she pulled a knife on him today when he came home from work. She has forced him to vacate the property. BIL called police out who were there when he was on the phone to us. She was screaming in the background like a lunatic. However, the police aren't very helpful when they deal with 'domestics'.
Anyway FIL & MIL went down there to pick his stuff up and BIL is now staying at theirs.
As for the Nisi being issued and then being ignored, why not? If the woman/man you love dearly has declared that they have halted the divorce and explained the 'misunderstanding' of the 'gay' colleague, why would you believe otherwise? Is marriage not supposed to be about loving your partner for life? She also claims, now, that she did not order the absolute and the courts did this automatically.
As shadej has said, forging a divorce is easily done.0 -
I can't get out of my head a whiff of an insurance / mortgage scam.
Are you sure the breakup is for real? They've been living together, having sex and taking out mortgages... is there any insurance on a mortgage where it gets paid if the partners split up? Just asking because I don't have a mortgage and don't know but that's what's creeping around in my mind.
Sorry if I'm wrong.0 -
If a signature is forged, wouldn't that make the divorce illegal though?0

You can't take a mortgage out in joint names on a property held in the name of one party. The whole story is more than a bit fishy.0
-
You can obtain a joint mortgage where only one person is on the deeds. Being on a mortgage just merely tells the mortgage company that you are going to pay and take part of the responsibility of the mortgage to them. As long as one person of the pair is on the deeds then the mortgage is fine.
Of course, if the signature on the divorce petition has been forged then the divorce is illegal.
BIL is seeking legal advice on this now.
Thanks for the useful advice.0 -
Maybe you should keep your nose out?
Stop calling her 'slapa', it's nasty.0 -

No they don't. The Court also needs to be satisfied that the financial aspects are dealt with & complete.
Perhaps he should check if he has any personal pension left. If any forgery has taken place to obtain the divorce, this could also have been part of the process.0 -
