Is there anything i can do?

Options
Hi, I'm a newbie :0)
I was just wondering if anyone knows if i have a leg to stand on?
12 months and 2 weeks ago my Husband bought me a new lcd tv from Woolworths.
The reason we chose this one was solely because it came with a 3 year warranty so we thought if anything goes wrong we will be covered as we don't have spare money.
The tv was Evesham. Yesterday when I went to switch my tv on it just wouldn't work. It's not completely dead as the standby and on light still comes on just no picture or sound.
Off i go and phone the number provided when we purchased said tv. The lady on the phone told me that Evesham have gone into liquidation and my warranty is now void but they were willing to sell me a package. I declined stating that no one told us about the liquidation and that I already have a warranty so should be covered. The thing i can't work out is that Evesham are still selling on their website and providing warranties in that name so I thought mine would still be valid.
I called Woolworths who told me they couldn't help and I'd have to sort it myself. I have written to trading standards to ask if I can get any help but I have a horrible feeling that there's nothing I can do about it. Now I have a £400 tv that's no good and two very disgruntled Daughters! I have absolutely no way of purchasing a new tv so I'm stuck.
I'm so glad I didn't have to pay for my warranty or I would have been so mad!
Thanks and sorry for the rant!

You are definitely covered under the Sale of Goods Act. In this case, Woolworths need to sort this out (your contract is with them). You are entitled to a repair under this law.

Rather than write to Trading Standards (this will take time). Give them a call today. They are in your local phone book. They can advise your of your exact rights in this case, and tell you the steps you need to take to resolve this.

By the way.............Welcome to the boards!

Hi, thank you for your reply :D
When I phoned Woolworths yesterday they told me that their cover only lasted 12 months and that the 3 year warranty was with Evesham. They were very abrupt and tried to fob me off. They told me in no uncertain terms that they would have nothing to do with this. I explained that I purchased the tv from Woolowrths and not Evesham so they should sort it for us but they just said no.
Thanks for the advice, I'm off to find trading standards phone number.

Woolworths are just plain wrong. The Sale of Goods Act covers goods 'for the reasonable lifespan' of a product up to six years. Your warranty was offered over and above your rights under this law (it does not cancel out your rights under law).

Let us know how the phone call went.

    Thank you so much!
I was really nervous as I hate complaining but I called Trading Standards this afternoon and they were lovely and very helpful.
They told me what you did and they explained to me that Woolworths are in fact responsible. They helped me word a letter to them and to tell them they have 14 days in which to reply.
I'm really grateful for your help as I'm quite a quiet person and I usually get walked all over because I'm not a complainer and am fairly timid.
Thank you for your help today.

    I'm really pleased for you.

You know where we are if you need any more support. Even better, you've got Trading Standards on your side, and you know how helpful they are now.

Well done for getting this far, and keep us updated as to how this goes on.

Now this is what this board is really about. People with real problems getting the help they need rather than wanting to know how they can get something for nothing or claim compensation for something trivial. Warms my cockles it does!

Well done Rex, and good luck OP!!

thanks very much. I'm so grateful for the help.
When I called both Woolworths and Evesham they told me there was nothing I could do.
After lurking on here for a while I finally found the courage to post and I'm so glad I did.
Some retailers are rats and don't give a damn about the consumer so I'm hoping this will be one up for the little guy (or Girl!)
    The help has been invaluable.
    Thank you!

You shouldn't have bought a TV from woolies in the first place.

    You paid too much.

You should claim compensation for the stress.

.....I just thought as this thread was the only useful/helpful/reasonable thread on the vent board, I should post the above, standard replies.

Well done on getting it sorted OP :D

Woolworths will have to sort this out for you, they sold it to you, end of story.

    Just a quick update!
Woolworths have written to me this week.
They said I have to get an independent TV repair person to come and see what is wrong with it and then when I tell them the problem they will let me know what they can do!
Does anyone know if I have to pay for a repair person to come out?
    Thanks....and sorry for being a pain :0)
