That's exactly what's happened to me, but I haven't heard if I 'll get the money back though.
WE were over paid Thousands even though I kept begging them to stop paying it to me. They INSISTED it was correct and then we had to pay it all back, and we still owe some.
I havent had any TC's all year as they are still taking it back off of me. They are still messing me about. HOw do you know tha Government are paying it back? Was it in the news or something

Yes apparently the Inland Revenue broke a law by raking the money back without forewarning the claimants

That's what i would like to know. I received a sheepish letter from them last year saying that my claim for 03 - 04 was going to be investigated and not to worry as i would not have to pay any money back. Just previous to receiving this letter i heard on the news about the law that was broken and a loophole in it says the IR have to reimburse the money but have heard nothing since.0

I was overpaid £2000 because they input my childcare costs incorrectly - someone at their end put in that my costs were £1400 a WEEK:eek: not £1400 a year. I kept insisting to them, both on the phone and in writing that my credits were wrong and they kept writing to me insisting that they were RIGHT. It was only when I got my end of year review that I noticed the £1400 a week thing and rang them up and they said "Oh sorry about that, it's totally our error so you won't have to pay it back" - then I got a snotty letter saying that, although it was their error it was reasonable for me to realise that the amounts were wrong (Doh! what did they think all my phone calls and letters were about) and so therefore I accepted them under false pretences and I had to pay it all back. When asked about the letters and phone calls they said that I shouldn't have spent the money as I clearly DID know that I wasn't entitled to it. I was in the middle of a divorce and it nearly sent me nuts dealing with them but, despite intervention from my MP I still had to pay it back and am still doing so. I would be delighted if they had to pay back recovered money but I somehow do'nt think it's going to happen!
Just read the article and it seems that only those who had money stopped entirely, and without any notice, will get their money back. I didn't have my credits stopped entirely and they did write and tell me so looks like I won't get anything, and will still have to carry on paying it back.Jane

Im sorry to hear about your awful situation. Did you receive a letter from them saying they were investigating your claim for a certain tax year, which is what i had? Ive got a feeling it will take years for people to get their money, different story when they want their money from us eh?0

Right just got off the phone to the TC hotline and they know nothing about this decision!!

They have clawed it all back and I still owe money but she said there was no knowledge of us getting that back.

Well you still might eventually get your money back but like me, i dont suggest holding your breath! ... lol

That's strange! ... i remember first hearing it on GMTV then in the papers back in September last year. I didnt even bother asking Tax Credits because theyre not going to advertise it. No doubt theyve told their staff to say that to avoid answering questions but i know the IR definitely broke a ruling. It seems to have just been brushed under the carpet0
