Ebay Paypal advice needed - Thanks

I bought a playstation 3 of ebay which I never recieved, and I payed for this via paypal.
I filed a case via paypal and they agreed that the seller should return my money -

Dear xxxxx,

We have concluded our investigation into your case and have decided in your
favour.

We were able to recover 290.00 GBP, and this amount has been credited to
you. Please allow five business days for this adjustment to be posted.

If you are due any additional funds, we will make our best effort to
recover the balance from the seller.


If the seller's account has insufficient funds to complete the refund owed
to you, please be assured that we will take appropriate action against the
seller's account, which may include limitation of the seller's account
privileges.

I then received the following message

Dear xxx,

The refund sent by xxx did not clear through the PayPal system. You have not received funds for this payment in your PayPal balance.

You may want to contact xxx regarding this refund

Does anyone know what I should do next? Should i be covered by paypal protection?

    The money will only be refunded if the op has it in their paypal account, from the sounds of it he/she has transferred the money into their bank account :(

    Thanks, is there anything else I can do? Shouldn't paypal protection cover me? Or can I take legal action?

    a) you could try the police, but I doubt they'll be interested. You might get a crime number out of them if you're lucky

    b) take out a small claims in the county court

    Note: if you do not know the name and address of the thief and/or you are unsure as to their financial standing, taking out a private prosecution may be just throwing good moeny after bad - a court will probably find in your favour but will only direct a repayment plan that the thief can afford.
    i.e. if they have no money and no income, then sadly it's unlikely you will get any money back.

    Cheers guys, I may try the small claims court route. I have contacted the seller. Its more about principal than the money - I can't beleive how bad paypal is!

    One more thing to ensure if considering court action - ensure the seller is/was at least 18 years old when the transaction took place.

    It's amazing how many ebay sellers are actually below this age (and ebay do little if anything about it even when reported). Unfortunately you cannot sue someone below 18.

    Paypal offer two levels of protection, the basic level of £150 which is only guaranteed if selller has the money in their account, and the full £500 of protection. If you check the auction listing it will tell you what cover paypal were offering.

    Paypal is only as safe as the person using it, what sort of feedback did your seller have and had they sold anything before and are they still listing?

    It was the £150 type of protection. The Seller had a feedback score of over 100 and a rating of over 99%, but he is now no longer registered with ebay. And I don't their contact details apart from a partial address. I am going to see if I can contact and sellers that have dealt with him and see if they will pass on his contact details to me.

    OP, how did you fund the payment? If it was credit card, you can take it up with your provider.
    My TV is broken! :cry:
    Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j
