Are application forms usable as a CCA

Been sent an application form I filled out for a credit account as a CCA by the DCA dealing with the account is this valid as a CCA,if not should I contact the dca or wait for the 12+2+30 to be up then get in touch??????

    I very much doubt that this is a valid CCA, what company is it?
    Also you do not have to do anything, although be telling them its not valid shows you know your stuff and wont be fobbed off:p

    the dca is network credit,and the account is a jewson trade account?

    Is it the original application form with your signature on it? Or just a copy of any old blank form?

    Can you post the form ? I would doubt all the account details would have been passed to a DCA . If it ever went to court ,you could request all account statements from the DCA , any missing , case dismissed ?

    So you have a copy of the form you know you filled in for a debt you know you owe and just don't want to pay.

    No thats not the case at all,I'd like to know how they have got to the figure they are at now!
    The application form is the one I filled in with my signature on it.

    The rule of thumb says an application form does not a CCA make

    BUT!

    If it contains all the prescribed criteria and terms and conditions and is signed by a representative of the company in a box that say something like ' by this being signed by the company and we send you a card then this costitutes a consumer credit agreement'. Now agreed this is wobble ground so it would be up to the judge to rule. You therefore need someone to look at it before you act. One ruling said that not all the prescibed terms need to be there as long as there are enough to work the rest out but what ever is there needs to be accurate.

    We all have to play within the law and the 'law is the law' we joe public have has much rights to be protectect by it and be able to use it as anyone else and if the lending establishments bend it or break it (like they do) then it is not joe publics fault that they face the consequences i.e. we do not pay them anymore money. It's not personal 'business is business'

    Sept 2006 Started dmp = 56k of Debt (inc fees and charges) DFD April 2030:eek:
    May 2008 = <5k of Debt (CCA route -48K, paid off 3K) DFD April 2010
    Nov 2008 Lloyds found CCA for 14K loan:mad: New DFD Jan 2016

    Happy so far tomorrows another day:confused:

    There is nothing on there about apr,and nothing to say that it constitutes a cca,it has a few bits at the bottom that say if I open an account they will search cra's etc,and that this form must be completed to open an account.
    I also want to clarify who I should be arranging payment with as there are 2 dca's chasing this,and I have in the past been chaased for a debt that was not mine!

    You must request a notice of ASSIGNMENT from ANYONE who is chasing you for money .
