    There's an old saying - "never bite the hand that feeds you" and this is a perfect case of when it should applied. Your sister was under no obligation or otherwise to let you doss in her flat and was kind enough to let you do so because you had nowhere else to go. Regardless of what "rights" you think you have to stay there, the simple fact remains that it was only a temporary measure until your sister got fed up and changed her mind, and that's exactly what she's done because you've "bitten the hand that feeds you" and now she wants you out. You should take some lessons in learning to keep your mouth shut when you're getting a very good deal.

    As for changing her locks so she can't get in - well, if you'd done that to my flat you wouldn't have 7 days to get out, you'd have 7 seconds plus a smack in the chops plus the bill for putting them back as they were. Who, exactly, do you think you are? :rolleyes:

    Two previous posters expressed their own personal opinion without contributing any facts.

    I've already said this in a previous post
    My sister actually offered me the flat as she was paying two lots of bills. I accepted as I was waiting to sell my property in England before I could buy here. I was intending to rent somewhere else before my sister suggested I stay here

    It was her idea and I could easily have went elsewhere but it was her that suggested I move in here.

Your sister's been trying to ask you to leave for some time, phoning you up in the middle of the night and asking you to go. You either have very selective hearing or you're pretty dense. Just accept it, you've outstayed your welcome! Move on.

    Exactly mumoftwins. There are many ways to express yourself without being rude.

    I know I've called him an idiot but it annoys me when people throw in their tuppence worth without reading the post. He's probably read the first post and commented with his opinion that bears no relevance.

    I think I've pointed out the facts to him though (again)

    No! she only told me last month that I was "welcome to stay as long as I wanted". I agree though that I have outstayed my welcome I just wish she had given me more time as it wouldn't have been a problem.

    She hasn't been phoning me just solely about my house hunting. She usually calls me when drunk and talks a lot of sh**e. The subject of house hunting has happened to crop up.

    Yes she is spoilt.

    Does she not realise that if you went to the HA to ask what your rights are that she will probably lose the flat anyway because I suppose she has in effect abandoned the property?

    I'm undecided on this one as I don't have enough knowledge about Scots law, but in England/Wales I thought that if you had a relative staying with you for a year or more then they have equal tenancy rights?

    I think this is the best advise given...move on as quick as you can, why do you want to stay there?
    A weeks notice may be too short but personnaly I wouldn't want to stay more, you can wait she cools down and let her know you want to leave but in x weeks.
