another problem buyer

I do hop eproblem buyers don't come in threes as this is my second in 6 weeks after having no problems for years.

I sold a brand new tagged item of clothing, and got a message to say item was poorly stitched and was coming apart at the seams. Obviously I said to send it back and I would check it out and refund if faulty.

I've got the item back today and yes the seam has pulled apart but the material itself has torn as through someone has forced this item on and it doesn't actually fit. This isn't stitches coming apart, this is actually torn..it also has been washed as it smells of washing powder and the material is soft when originally it was quite stiff.

I can't decide whether to wimp out and just refund all her payment and send her a cheque for her postage to return it, or actually tell her I think she has torn this by trying to wear it when it is too small (there is no stretch at all in the fabric and I warn about this is the auction). She's a fairly new seller who has a few positives but has never left any feedback herself.

Bother bother bother..I can't even return it to my own stockist as I wouldn't have the cheek when it is so obvious it has been worn and torn.

    Nope both tags are missing, not even in the packet. However, I would still have refunded without tags if the item had a fault, but this just looks torn.

    Personally I would not refund her any money, but if you do then I dont see why you should refund the P & P.

    If your item was as described and had no "give" in it then its obvious that she tried it on, got stuck and had to be pulled out of the item.

    In doing so she succeeded to pull the material from the stitches.

    Good luck with what you do but dont be bullied into refunding the item

    i had somebody tear a pair of fabric boots, i said they came up a size small but it seems i was ignored (previous footwear purchases in their feedback showed that they bought the same size as normal and didn't go up a size as i advised) and they forced their fat feet/legs in to them and ripped them! they told me the seam had split, but when i got them back the seam was still in tact and the material had torn away from it due to being under pressure.

    they wanted an exchange but i didn't want the same to happen again so i reluctantly let them return for a refund as i got threatened with small claims court and didn't want the hassle or neg feedback for the item as i was selling lots of them. they also declined the mutual i sent and i still got neg feedback, stating that the item was fake and that i kept their money! fortunately i got ebay to remove it due to them stating that the boots were fake when i had proof that they weren't.

    I don't know what to do..I'm wondering about waiting 24 hours to reflect on it and to see if any more feedback comes in for her. She has been on a hell of a spree and as I mentioned earlier despite approx 15 purchases around the same time as mine she only has a 3 feedback left by sellers for 'fast payment' but has not yet left any in return. I would normally discount feedback left by sellers who do it automatically immediately payment has been received as it doesn't show that they are happy with the entire transaction, just that this buyer pays quickly..which she does.

    There's something in the air I have 2 items on their way back, one didn't fit and so they're saying the sizing is wrong despite many other happy buyers and another today say they received a torn dress. I know they didn't as I pack with DH and no way 2 of us would have missed it. They also want a refund now and then they will return it - yeah right.

    Hey flo flo, my buyer is a rogue as another seller has had an item returned damaged deliberately so maybe your buyer is the same one as mine?

    I hade refused my buyer a refund, although I know if it goes to paypal I will probably lose anyway, but it is the principle of it. I've now had some very strongly worded emails calling me all sorts of nasty things, so I've sent them all in to ebay as feedback extortion.

    Well I sent an email to return the item and will inspect it and refund then. Haven't had a reply yet but judging by the tone of the first message it won't be nice. I checked their feedback and nothing to suggest foul play, they also haven't bought anything similar that they could have confused or swapped it with. It is however more expensive than they normally spend on clothes so I'm wondering if they've worn it and decided to send it back for a refund.

    How does it work if you receive the item and there's been foul play do you have to send it back to the buyer while you fight the dispute. I've never had a dispute before , couple of nutters but no disputes.

    Well mine is likely to go to dispute and what will happen is that they will almost certainly claim they received a damaged item which I will dispute as they have obviously damaged it themselves. Then unfortunately paypal will probably find in their favour and will refund th ebuyer the full amount they originally paid, the only advantage to letting this go to a dispute is that firstly buyer does not get their return postage back and if they make a habit of this (and they are already well on their way) they will run out of chargebacks attempts. So if anything I might be saving another seller further down the line.

    I know some buyers try it on but this is so blatant, to actually rip something take off al the labels and wash it and then insist that is how I sent it :confused: Daft thing is if she had just returned it unworn with labels attached I would have refunded without a whimper.

    Have spoken to OH now and he says there is absolutely no way any of the dresses were damaged. Have had lots of glowing feedback from others. I know I always check everything I sell but doubted myself for a moment until speaking to OH.
