My problem is as follows.
I scrapped my car in april 2004 and wrote to the DVLA to inform them of this.
I never received a reply from them to acknowledge that they had noted the car had been scrapped, but to be honest I never gave it any more thought.
In July 2005, a CCJ was issued against me at an address I moved from in 2003, regarding the car I had scrapped. The fine was a late fee for not taxing or declaring the car off road.
Apparently, the DVLA never received the letter informing them I had scrapped it, and the CCJ for £100 has shot my credit rating to bits, so I cant get a mortgage.
I have spoke to the DVLA, and they said I can pay it now, which shows as a satisfied payment, but does not come off my credit score for 5 years.
Or I can go to court in an effort to have the CCJ set aside, in which case I wont have to pay, and the CCJ comes off my credit rating.
CAB have been next to no use. Has anyone else had a similar problem, and what are the chances of the court siding with me and getting this CCJ off my record.
I realise that I dont have any proof of sending a letter to the DVLA, and they will have proof (I assume) that they never received it.
Is it worth my while taking it to court, or will this just land me with even more costs?

Do you have any proof of scrapping the car? That could maybe be used as evidence to show you did actually dispose of it.0

Yeah but he's unlikely to have proof of scrapping. I scrapped a car around the same time, I paid a scrappy 10 pounds to take it. I got a reciept but doubt I have kept it. I filled in the V5 saying sold to a motor trader and I don't think I heard anything from the DVLA either.
Perhaps OP (greg), You could ask the scrappy to look in his files and see if he can give you a copy or a headed letter saying you passed the vehicle on to him back in Apr 2004.
Greg, you say you wrote to DVLA, this is a curious choice of words to use, did you send them the V5 with the details of the motor trader?0 -
If you are in a hurry to get a vehicle SORNed you can do it on the phone you need the logbook or reminder letter, 0870 850 4444.

exactly the same thing happened to me (leahs other half) i paid it but it annoys me i cant have it removed because i am looking to get a mortgage and that is hard enough as it is!0 -

You can have the judgement set aside because you were not at the address (and can prove it) where the court papers were served. You need to apply to the court to get this done.0
