Item not received

I paid for an item on 19th April, being sent by 2nd class.

Seller says it was posted on 21st, looking at other feedback I believe this. But i still have not received it. Seller says they have to wait 15 days before making a claim, and they have had a few items that seem to of got delayed lately how long should I wait before logging an item not received? I want to be fair to the seller if its delayed but I have never had anything not arrive, is there a delay on 2nd class stuff at the moment, surely it should be here by now? :confused:

    It should be there by now.

    If seller is a good egg they'll just refund you and chase the post office themselves as it is after all down to them to get whatever it was to you.

    If you haven't already done so try your local sorting office, it may be waiting there for you. Failing that contact seller again and tell them you'll have to open a dispute if they don't sort it for you. I'm assuming it wasn't sent recorded.

    You have waited long enough. Assuming you paid by paypal open a dispute through paypal (not a chargeback yet) and just state that item has not been received. Follow that up with a request for a refund. If selelr doe snot respond or again asks you to wait then just escalate that dispute to a full chargeback.

    If the seller cannot prove delivery then you will win the chargeback. The seller's claim with the RM is nothing at all to do with you and seller should not expect you to wait several weeks while he chases up for his claim.

    To save a lot of badwill, I tend to allow the 15 working days to elapse from the seller claiming to have posted the item (assuming, as in this case, they posted it promptly and have good feedback history) before starting a dispute.

    This is because I have on occassions had items delivered 2-3 weeks after posting (and so made my own claim against RM for delayed delivery)

    We all know that RM will reject any claim by the seller made before the 15 days, and if you open a dispute before this time, expect the response to be kindly wait (as requested) until 15 working days after the declared posting date to see if the item turns up as this is how long RM say it takes before the item can be considered lost.

    Remember, that when a dispute is raised to a claim, a human being reviews the comments made and makes a judgement based on those comments. It could be that someone who refuses to wait the 15 working days is being seen as unreasonable by the reviewer and so may end up losing the claim.

    I do agree, however, that buyers should not need to wait until RM settle a claim with a seller before getting reimbursed as that can take anything up to 3 months.

    a claim will only be lost by a buyer if seller can provide proof of delivery

    It doesn't work like that. A buyer can start a chargeback as early as day 7 after payment, paypal review the case and wait a little longer and then if seller cannot prove delivery the buyer gets their money back. There is no case whatsoever where starting a claim early will hinder your chances of winning a claim.

    Thanks for the replies, the seller has proof of posting but was not sent on recorded. It is one of those sellers who has a note on paypal saying they get proof of posting and can not be held responsible...how does that affect me if they did not send recorded?

    Item still is not here and my posties are very good with leaving cards if they get no answer, I have had other items delivered no probs. Such a pain as I really wanted the item. :rolleyes:

    The sellers stupid terms and conditions mean nothing, ignore them. In fact those terms would worry me as it shows the seller is TSFE..and in that case I would start a full chargeback immediately, don't even bother with the dispute first.

    Whilst you are correct in stating the chargeback can be started as early as 7 days after payment, how do you know what is in the mind of the reviewer. If I was reviewing a claim and saw that someone was so impatient as to wait a few extra days to see if the item arrived before demanding a refund, I wouldn't be impressed.

    ... and don't forget, if the claim does go ahead and the buyer gets a full refund and the item subsequently gets delivered, then the buyer will need to refund the seller the cost of the claim (or face possible legal action).

    Whilst I've had quite a few items delivered 2-3 weeks after the date it was posted, I've not yet had an item delivered 15 working days after the date on which is should have been delivered.

    This, together with the fact that the seller as politely requested the seller to wait until the 15 days have passed, is why I suggested waiting rather than aggravating the situation.
