    Can I just ask, does the 6 years start from when you last made a payment, or does it start from when a default was registered against you? I ask because I have a default that was put on between 12/24 months after the last payment was made.

    It starts from the last acknowledgement of the debt, i.e. the last time you paid it OR the last time you sent a letter acknowledging the debt.

  • HI everyone , this is my first post so please dont shout if i do something wrong
    from reading this post I have got alittle bit worried .I had an IVA which was a settlement lump sum one( remortgaged to do it). On my Experian report it shows a default to a company that MBNA sold the debt on to( this was included in the IVA)..Can anyone tell me whether at any point they can cahse for this, I have received letters from them saying for info only not a demand for payment but i am worried that it will be sold on and someone somewhere will start chasing me just when I am starting with the help of this site to manage my money better.

    AFAIK, if the debt is included in an IVA, and you keep the terms of the IVA, no one can chase the debt further.

    i have recieved a letter from DEBT MANAGERS LTD saying

    "as a result of your communication we write to advise we have closed our file and returned it to Aktiv Kapital.

    "We can confirm no further action will be taken by Debt Managers in relation to this account"

    Thank you to all who have helped me in this matter, thank you for the standard letters which helped resolve the situation. Thank you, thankyou.

    A few words of advise for anyone having to deal with these guys, BEWARE! They offered me a 25% discount on the debt then a 50% discount on the debt even though it was expired under the 6 year rule. Funny thing is that even if the debt had been five years old, they did not have a sighned copy of the credit agreement, sothey couldnot prove the debt. So even if your debt is less than six years old you may as well ask for a signed copy of the agreement, you never know they may not be able to find it.

    Hope i'm not stealing the thread but thought it best to keep the following in here as it relates to Aktiv Kaptial.

    Here goes...

    My father received a letter, think it was a final demand or something, from Debt Managers Ltd (Edinburgh office as we're in Scotland) some months back claiming he owed over a thousand pounds to Aktiv Kapital FI-Ilford Audio Centre.

    He doesn't keep good health (he's 66 this year) and this nearly put his recovery back no end... so i was a litte annoyed about it to say the least!!. Anyway i phoned them claiming to be him (naughty but there is no way he'd have been able to do it himself). I told them i knew nothing of this debt.. they then asked if my wife (i.e. my mum) was still alive.. maybe she'd remember it!!

    Again told them i know nothing about it, have never been to Ilford and have never bought any audio equipment on credit. The woman said she'd put on file but that i might get another letter in the future.

    Today my mum has just brought me another letter ... this time an URGENT FINAL DEMAND.....she's worried about showing it to my dad in case it effects his health/state of mind (he's a born worrier). It's from Debt Managers Ltd again claiming he owes £1,315.64 to Aktiv Kapital Fi-Ilford Audio Centre.

    Having read this thread it looks like this crowd are just chasing names ... my parents did have some moeny problems a good 7-9 years ago (mainly credit cards and late mortgage payments) but they genuinely don't know anything about this.

    My thoughts are to send the 'more details' letter with the £1 PO in it to see what they come back with. If they have anything, which i seriously doubt, then it will probably be outwith 6 years.

    I'd be grateful for any advice anyone can offer on this.

    Does the fact we're in Scotland effect the legal side re credit acts etc ?

    One question.. If they cannot produce a signed true copy of the credit agreement, then are they obliged to remove any default from your file?

  • Ok thanks for the help you peaple for Aktiv Kapital as i recieved one this morning for a debt back in 1996 from dept managers ltd. On the same morning i also recieved a letter from central debt recovery unit for a HSBC credit card from 1993 for 4800.00. I had a card with a 5000 limit which my ex blew away and also other debts bought out in our name without me having any idea of where our money was going. We started paying Aspire (a debt manager) £350 a month for a year only to find that hardly any money was paid. With all the stress my partner left me to go back to her parents and declare herself bankrupt at a cost of £450. I have over the years have had letters from HSBC then from DG Solicitors on there behalf untill 22 march 07 and now from Central Debt recovery unit of which i must say, i could draw up the letter myself on any computer as it is very tacky. I have no money even to go bankrupt and dont own anything, not even a pot to p*ss in or a window to throw it out off.
    Any ideas or loopholes welcome but no ideas about me getting a long rope as i have already thought of that and i cant afford it.
