QUITE FRANKLY THIS COMPANY SHOULD BE CLOSED DOWN. THEY HAVE SENT ME 4 LETTERS IN TOTAL, ONE OF THEM OFFERED TO GIVE ME A DISCOUNT ON THE SUPPOSED DEBT. WHAT A JOKE. MY ADVICE DONT PAY THESE SCUMBAGS ANY MONEY IGNORE THEIR LETTERS OR SEND A RECORDED DELIVERY TO THEM ASKING WHAT THE DEBT IS FOR. IF THEY CANT TELL YOU TELL THEM THIS IS HARASSMENT. IF THEY DO THEN PHONE CONSUMER DIRECT ON 08454 04 05 06. AND THEY WILL ADVISE YOU ON FURTHER STEPS TO TAKE. I GAVE THEM A RING TODAY AND THAT IS WHAT THEY TOLD ME TO DO. I WONDER IF THE POLICE SHOULD BE NOTIFIED.
I WILL KEEP YOU UPDATED WHEN I GET THE REPLY TO MY LETTERI recieved a letter from CALL SERVE yesterday saying I had recieved goods or services that I hadnt paid for and they were working on behalf of Aktiv Kapital, they said I owed them 844.00.
So after reading this thread I called them.......the woman got very shirty with me and said I owed the money from a Debenhams account from 1998!!!! I could tell from the echo on the line that I was being recorded so I said to her "are you recording my call because I am recording yours" she said " we can record your call because it says so on the bottom of the letter", I replied that the only thing on the bottom of letter was do not write below this line!! She then said " Oh well Im not happy that your taping me" she then terminated the call after asking me to put in writing that I did not acknoledge the debt/ 6 year etc.....
I sent my letter recorded delivery yesterday afternoon.........
I will let you know how it goes.
PS she did keep trying to say that Debenhams had been trying to contact me and that I had made a small payment 3 years ago.....I asked for proof of this as I know this is untrue.......so lets wait and see what reply I get.:rolleyes:0 -
Just like to say thanks and ask a few questions. I've used this thread a few times whilst trying to sort out my partners debts. I thought I would only have to refer to the first few pages for info on the CCA. But little did I know how many forests AK are willing to cut down to try and collect a prospective debt...
Aktiv Kapital under the guise of
Buchanan Wells & Clark chasing a debt which they couldn't provide copy of CCA and has now gone beyond 12+2+30 - letter sent recorded today. This possibly could have been a legitimate debt. Though without proof we will never know.
Thames Credit chasing a statute barred debt (we assume it is statute barred as the default date is June 2002 on her credit file - though she doesn't recognise the debt). Statute barred letter sent but no response.
Thames Credit are recently chasing two more debts of unidentifiable amounts. Just started the CCA queries on them.
All three of the Thames Credit letters use a reference of "Re Agreement Number 6319XXXXXXXXX GE capital global consumer finance limited". Would I be right in thinking that GE capital global consumer finance limited are not the original creditors, and that it may be a report from GE capital that AK are chancing their arm on? If so how can I get to access the data held by GE capital? SAR?
My query is whether anyone thinks it would be advisable to send a SAR request to Thames Credit (or Aktiv Kapital as the holding company?), just to see if they have any other silicone coated mud they want to fling at her.
Or even employ a solicitor to make them "put up" or "shut up"
I have debts of my own which I can not consolidate in to a loan whilst her credit file is in such dissaray. And would like to hear from those people who have dealt with AK successfully how long it takes for the bogus entries to be removed from your credit files.

Wish I'd found my way here earlier, what an outrageous bunch of shysters AK/TC/BCW seem to be. I don't understand how such companies are allowed to operate like this.
Anyway I have just had my first letter from Buchanan Clark & Wells, followed by a phone call the following day. This is probably about the 15th letter I have had relating to this matter over the last 4 years, as well as several phone calls. All letters have been ignored, in all calls I have refused to verify my identity as I saw no reason to participate in what I believe is a total scam. Originally the name of First National Tricity or whatever appeared who I had never dealt with, though I did once have a Dixons storecard which I think was financed through Lombard Tricity. I defaulted on this in late 1996 or early 1997 in the middle of a very difficult period and received a date for a county court summons (after the appointed date as I was living abroad). When I returned to the UK I discovered that a default had been added to my credit file, but I'm sure it was a default rather than a CCJ. I had to get by for a year or so with a basic bank account but once the 6 years was up (2003) I got a proper account with another bank and have rebuilt my credit rating to a very high score which I wouldn't want these chancers messing up, however temporarily. The amount of the default and amount now requested are not the same, maybe a couple of hundred difference, but I can't think of anything else it might relate to.
So, I think it is time to request a copy of the agreement and have my postal order at the ready but I'm not sure where it should go. Should it be BCW (I have my own version of what that stands for!) as they now seem to be handling the attempted con, or Aktiv Capital as the initial instigators?0 -

bit of advice requested please.
Having moved a couple of years ago I met up with an ex neighbour at the weekend who gave me a bundle of letters that had arrived recently at my old address. 4 of them were from Aktiv Kapital regarding an outstanding debt of £700.
I was about to contact them but having read this excellent thread about their tactics, I am left in a bit of a dilema:
Do I contact them with one of your template letters asking for proof of the debt etc and give them my new address (thus giving them more chance of further harassment).
Or do I disregard the letters and see what happens?

stormstorr - do you know if you owe any money? If you are sure you don't, check you credit file to see if this debt is there. If you check your credit file and update your address, DCA's will have access to this so be careful.
Do you know how old these supposed debts are? If you have made no payments for 6 years the debt may be statute barred.
GTG - see 2nd paragraph. If you have made no payments towards the debt or acknowledged it in writing, it will be statute barred - unless there is a CCJ. I would write informing them of the statute barred status and leave it for them to respond if there is a CCJ or not. Then you can try to see if that CCJ is enforcable or not.After falling off the gambling wagon (twice): £33,600 (24,000+ 9,600) - Original CC Debt: £7,885.91

I've been looking through some old papers and found an early request from Lombard Tricity, and a copy of my Credit Reference report from Experian some years later and it is definitely listed as a 'Default' rather than a CCJ - presumably if it had actually gone to court I would have received some follow up paperwork. The last I heard of it was the notification of the date of the hearing. The numbers do match up with the AK/TC/BCW references so at least I know which 'debt' they have been chasing all these years.0 -

No! Despite several threats that they were sending round their 'agents', no one ever called. I've also since had several letters stating "pay up in 7 days or we will take you to court" - ok, you do that! Hi. I really need advice on these jokers. They are chasing me for an alleged debt to GE Capital. I sent off the £1 request for info, but I never heard anything within the allotted time (2+12+30 days) so I fired off the appropriate letter. I then received a letter from their 'legal' department, so I sent them a copy of the same letter, and another back to Debt Managers/Aktiv Kapital. This was in middle of October, I now have received another letter 21/11/08, it shows they recieved my 2nd 2+12+30 letter on 17th October and have sent me a photocopy of an agreement with a dodgy signature and some screen shots of what I can't make out. I wish I could get proper legal advice but it's not really an option financially. How long can they do this for?? Should I just resend the letter again, or is there a more strongly worded one?0

princesspop - they are legally obliged to provide a copy of an enforcable CCA. As they have not done so and are still pursuing you for the debt, inform Trading Standards and the Office of Fair Trading. That's the next step as these fools will continue to ignore you and think they are above the law.
