I have joined the merry bandwagon of recieving one of those letters from Aktiv Kapital UK through buchananclark+wells
Naturally I havent a clue what the debt is for but my question is thus...
Does all the stuff mentoined here apply to Ireland....
Yes Im an Irish Individual being approached by an Irish Solicitor Firm, or whoever Buchananclark+wells is, to pay a "debt" owed to Aktiv Kapital which I know nothing about!

Further developments! Another letter from Thames Credit this time stating we have made contact with them (we haven't!) and demanding repayment of over £12,000!!!!No idea what this is! Offered a substantial reduction if paid immediately or 6 months in instalments. We have sent back by return the standard letter demanding details but will NOT contact them by phone. This one is really upsetting and without phoning we don;t know how to fight back. Any suggestions please?0

Hi, my tactic so far has been to simply ignore every letter and demand for money they've sent no matter how menacing and threatening they are.
Since my last post I've received yet another stating they are making an application to ******* County Court for judgement against me. I must admit this one has rattled me more than the rest but I'm going to continue to sit tight until the point any court summons actually lands on my doormat.

Unfortunately defaults are difficult to get rid of.
I did a post here that may be of use, but you may want to check with the consumeractiongroup forum whether what i wrote would hold water or have any impact. They have a good handle on the legalities. I believe they also have template letters you can send to regulatory bodies.

Thank you GeorgeUK for your advice re Aktiv Kapital. I haven't heard anything more about this so hopefully they have gone away for good.However, I'm now in a bit of a pickle with a company called capQuest for an old electricity bill that was in my name which I never settled. I got a letter quoting dates including time that I was not in the property, contacted the electricity company and asked them to send me a copy of the bill. They have done, and it does indeed cover a time after I had moved out. The difference is around £140 and so I really don't want to pay the full whack. I've got bank statements from around that time (although not covering all of it) showing my then-new address - will that be enough proof for them?0

It should be - i would send copies of the proof to both companies though. Some DCA's don't seem to take much notice if the debt isn't yours but i would get confirmation from the electricity company that they agree the debt isn't yours - then if the DCA are still being a pain you can show them a copy of that confirmation.After falling off the gambling wagon (twice): £33,600 (24,000+ 9,600) - Original CC Debt: £7,885.91

Possibly not! If they're anything like Anglian Water they will require proof of the actual dates you moved out of the property this electric bill relates to, such as a letter terminating tenancy agreement or a final utility bill. Hi new poster to the site and as many of you have done already have goggled Aktiv Kapital and came across this thread. Well on Saturday morning i received a letter from them claiming i owe £197.60 relating to an agreement with GE Capital (formerly First national tricity finance) strange thing about this letter is it is adressed to me under my old (ex husbands) surname which i haven't used for around 9 years now, it has also been delivered to my parents house (only moved in there a year ago - although i did briefly live there in 1994). I am pretty sure the debt isn't mine as everything i had when i was with my ex was cleared off, what to i do as i don't know if the fact that the surname is incorrect means i could ignore it but at the same time if i leave it will my parents be blacklisted?

Hi Scotschik
The debt is probably statute barred so i would just send them the statute barred letter. If you haven't made any payment towards the debt for 6 years (5 in Scotland) or acknowledged the debt in writing, the only way they could enforce the debt is if there was a CCJ or decree against the debt. They will notify you soon enough if there is.
