    Vinnerisions - it looks like they were on a fishing trip and probably sent that same letter to lots of people. As the address they quoted wasn't yours, they can't discuss someone elses account details - just ignore it and they should go away.

    TB - Did you send the £1 payment with the CCA request? If so then after the 12(+2) working days had passed, the debt was in dispute and unenforcable. Have you sent the 12+2 day letter?

    I did send the postal order but I haven't sent the 12+2 letter as I was waiting for the 12+2+30?

    I guess I should send them that letter then? If it is my debt though, I will still need to pay them though won't I?

    Sorry for all the questions, I have read the thread but am getting a little confused!

    The CC Act covers loans, credit cards and catalogues. It does not cover bank accounts or mobile telelphone accounts.

    If the account is covered and you have not had a CC agreement then they are in default and should not be contacting you at all.

  • Am new to the forum and need some advice please from old hands. In the past month we have received 3 letters from credit agencies (2 from Thames Credit) all quoting Aktiv Kapital for debts totalling thousands of pounds! None of the letters state what the debt in question is only giving 'account references'. We know nothing about any of these debts and on the advice of this forum sent out the standard letter. No reply as yet except for a phone call asking to speak to the person named - we were 'not in'. Any advice on next steps or do we just sit and wait?

    Ok, having failed to carry out their threat of sending their "agents" to visit me, Call Serve have now sent another letter entitled - NOTICE BEFORE PROCEEDING WITH LEGAL ACTION.

    They state "failing settlement of the debt within seven days we will request our Clients[sic] authority to commence legal action and it will be our intention to enforce any judgement given."

    I'm wondering who their "Client" is. Would this be Aktiv Kapital or the original owner of the debt, whomever they may be?

    Also, how likely is it that they will proceed with legal action and would any court be able to make judgement against me for a debt that I have absolutely no knowledge of and have never even been in contact with either AK or CS :confused:

  • Have today received a letter from Thames Credit giving no further details but asking us to phone them 'to ascertain certain important facts in relation to this matter'. To phone or not to phone that is the question. Shouldn't they already have 'the facts' before they contact you???Help please.

    Would agree totlally. It is against OFT Guidelines to pursue someone for a debt which you do not know belongs to them.

    Do not phone. It is probably a fishing trip sent to all and sundry with the same name.

    If they start court action they have to provide details of the debt, then do a full SAR request which forces them to disclose everything they have regarding the debt.

    If this dies not arrrive in time, then your defence is you have not idea what the debt is and wwant the case delayed until the twits provie that information.

    I recently sent the 12+2 letter to Thames Credit but before they could have received it they sent me a letter saying that they can't process the request as they don't have the relevant information, despite repeated written requests. They have returned my P.O and are still asking for me to ring them 'without prejudice' so they can 'confirm the required information'.

    Any thoughts anyone? :confused:
