Aktiv Kapital (UK) - Who Are They?

  • Hi all

    I have had a letter from Aktiv Capital today. It was addresed to my house, when opened it was not my name on the letter. It says that the person who's name it is in owes money to GE Capital.

    I have lived at this address for 9 years in march and have never heard of this lady, it wasn't even the name of the lady we bought the house off.

    I have rang them and told them they have the wrong address and said they would deal with it.

    Am I likely to have any credit problems with this or does it not work like that.

    Hi

    credit records are personal, not acssociated with the address, so you will not have problems.

    What yoo do need to do however is to contact the Information Commisioner and tell them that Aktiv sent you someone else's debt details in contravention of the Data Protection Act. They will probably ask you to send them the letter and they will deal with AK.

    I have just recieved a letter from Aktiv Kapital today saying that I owe a debt of £600.00

    I am concerned as I know I do not have any debts etc, and am wondering why I have been sent this letter.

    Does anyone have any advice on this and what to do- I don't want to ignore it and it turns out to be something that I need to pay for, even though I know I dont have any debts.

    Any help would be appreciated!
  • Received my first Aktiv Kapital letter today. (Though my other half has been dealing with 1st Credit for a couple of months now).
    In short they are chasing me for an unpaid overdraft that was foisted on me as a poor impoverished student back in the late 90's. To the best of my knowledge I have never paid anything back to the bank after closing the account around 1999. I had no correspondence from them until around 2004 when I began negotiating a repayment scheme, though in the end they never agreed terms so no payment was ever made.
    Jump forward 4 years and this is the first I have heard since then.
    My question is, for the debt to be statute barred would it be six years from the original agreement or six years from the last date they had any contact with me?

    The 'Limitation Period' is six years from either your last payment towards, or your last written acknowledgement of the debt:

    I just got a letter from AK saying I owe £922 for a GE Capital storecard. I had three cards with GE Capital, taken out in 2002, and due to unemployment at the time they were paid off through CCJs in 2005. I know all three were paid off - however I moved house two years ago and my document folder went missing, so I don't have a copy of the paperwork to check the reference number against. I'm going to apply for copies of my credit report just in case, but in the meantime, should I just send the 'I do not acknowledge' letter given it was only three years ago? They sent it to my address in London (the one at which I receive my bank statements etc.) and not my parents' address which the storecard and CCJs would have been registered at.

    I am currently paying off an old overdraft and some overpaid housing benefit so I can't afford to take on another debt right now! I'm a bit stressed and worried to be honest - reading through some of the thread I'm glad it's Sunday so I didn't phone them straightaway. I also have no desire to deal with them on the phone - earlier this year I had a duplicated debt and the company I rang to tell them it was paid off asked for my NI number and address of my employers, and it took a stressful afternoon of ringing the council to sort things out!

    I have done a bit of Googling and am wondering - if I don't have the paperwork to show that I have paid off my CCJ in full, how do I go about obtaining a copy? I can see it's possible to get a certificate of satisfaction but this also involves submitting paperwork to show that the debt is paid in full. I no longer have this! Could I get the letter demonstrating that the debt has been paid in full from GE Capital themselves?

    If all 3 debts were with GE, you could do a "subject access request" (SAR) without specifying an account number and under the data Protection Act, they would be required to provide you with a copy of all information they hold on you for the past 6 years (cost £10). This should show what the payments have been made if the payments were going to GE.

    No 'paperwork' necessary, mippy. Provided you quote the case number, the Court will be able to tell you if the CCJ has been satisfied.

    I have had an e-mailed response from Experian:

    In view of your comments about the account with Aktiv Kapital, I am writing to them for you, as I cannot amend your report without their consent. While I investigate your comments, I am adding the following statement to the information you have queried.

    "THE CONSUMER HAS DISPUTED THE ACCURACY OF THIS ENTRY AND WE HAVE THEREFORE ASKED THE PROVIDER TO INVESTIGATE IT. GIVEN THAT THIS DATA IS DISPUTED, PLEASE TAKE CARE IF MAKING AN ASSESSMENT OF ANY KIND THAT MAY INCLUDE THIS DATA."

    I will let you know what they say as soon as they reply.


    Also as the 'apparent' debt was supposed to have been from June 1003 it can only stay on my file till next june.. whilst experian investigate I will wait and do nothing. I do not intend to contact them or reply until I hear back from experian..

    Its shocking that a company can do this- as when i even asked if they had evidence or a contract they said no.. how are they allowed to function like this?
