Agent lying about gas safety check!

    Unfortunately they can, subject to the terms of your contract of course. If you have no contract they can give 2 months notice for any reason they like (subject to the rules about discrimination etc).

    The landlady might have nothing to do with it for all I know as she may have it in her contract with the agents, that they sort the safety checks out.

    I do have a tenancy agreement, so under what terms would they be able to evict me in these circumstances?

    Exactly - you know what the legal requirements are. Far easier to not renew your contract and get a tenant in who can't/won't/doesn't know how to complain, than deal with a tenant who actually demands a service for the money they pay ...

    I don't demand a service for the money I pay, I just want the gas check done and for the agents to stop lying through their teeth. The gas check has to be done by law, so it doesn't matter whether I pay them 1p a month or 10K a month.

    It's the agent I have my knickers in a twist with, not my landlady.

    And what do you mean, not to renew my contract? It's never been renewed since I moved in almost 10 years ago :confused::confused:

    Usually you sign an agreement with your landlord called an AST (Assured Shorthold Tenancy).

    Usually it lasts for a year at which point (s)he can ask you to leave/you can choose to leave/you can sign a new agreement or you can stay with no new agreement (called a periodic tenancy).

    Often, the AST will have a Break Clause, that is a point before the end of the contract where you can give notice or be given notice. The most usual point for a break clause to start is after 6 months.

    I missed the bit about having no new contract. That means you should be on a periodic tenancy which means you have to give a minimum of 1 months notice to quit and be gioven 2 months if the LL wants you out.

    All I can offer is my own situation - I'm in a similar situation to you, where we're having real trouble with the LA, having to nag for gas safety checks, having to beg for repairs to be done, phone calls not answered, blatant lying. We have been told, by the agent, that it is not a good idea to 'bother them' too much, as they can advise our (totally disinterested) LL that it would not be prudent for them to renew our contract. In other words, shut up and sod off. So, in our case, we have had to make a decision between living in a not very nice house but being able to stay, or complaining about it and probably being chucked out. We have taken the latter option and I spent this afternoon on the phone with the NAEA Ombudsman, as things have got that bad.

    It's a well known fact that many tenants are too scared to ask for repairs because they can't afford to loose their 'homes'. Shelter have just written a report on this. Currently a LL does not need a 'reason' to evict you, and it's well known that many LLs will evict a tenant who asks for repairs/legal compliance on the part of the LL. I'm not saying that this will happen in your case but it is something you need to be aware of.
