when I got the incorrect default against me removed
I named HFC, Experian, Equifax and Call Credit as the people I was looking to sue for defamation.
this was over 6 years ago
I am certainly no stranger to legal action against financial institutions for bad data, long before the current craze of claiming back charges

Rico6.9 - Well done. I salute you for standing your ground and seeing this through. No doubt the last 9 years was a nightmare for you and your family. I am glad that you will get some financial compensation as the stress and the time lost in dealing with this case cannot really be compensated enough.0

Yes the lost time particularly is a shame. I am happy though that the time should save others from the same nightmare.
The appeal needs to happen to ensure that the reasoning is correct.
At the moment, the sheriff's reasoning is that I lost out on the property boom.
I need this adjusted to read I lost the OPPORTUNITY to buy a permanent family home in a very pleasant part of the world. I was never interested in taking advantage of the "boom".
The difference to me is another £100 000 ish. As time goes on though interest rates continue to rise as do (in the area I'm looking at) house prices!
The difference between m00m00's case and this was PC World. HFC didn't help because they didn't want to lose business with PC World.
I hope they'll think twice now. Remember though:
You can only claim for damages that happened in the last 5 years.
A lot of this has been a battle with the law itself! I'm trying to get my MP (and my MSP) to look into it......
I didn't manage to get hold of Martin but I think that you guys agree that this is a big deal.
Thanks for the encouraging words. I really hope others benefit. I wonder when it will hit the English press?0 -
well done you - going to court is an arduous process and I commend you for going through with it.
I was rejected for something due to a bad credit rating - and when I contacted the rating people it turned out I had NO rating as I had no debts. Stupid bank clerk assumed that as there was no rating it must be a bad rating.0 -

You're in the same position as my wife! She's been told that she needs to use her credit card more, set up some direct debits and open a savings account to make regular payments into it.
All the debts were in my name! She's now allowed to have some of them!
Finance people today don't often use common sense. They seem to rely on stats. If there aren't any stats, they're at a loss.
Did you try asking your bank manager for his view? I believe there are still some old fashioned guys left.0 -
I should have mentioned that people in the same situation as me only have 5 years to sue. If legal aid is possible it's definitely worth it, even if it's just to claim the basic £8000.
Sadly my MP isn't helping as I had expected so those of us ineligible for legal aid would still need to be prepared to suffer a great deal on the way to reparation.
The bank is using delaying tactics in the appeal system that could drag this out until 2010!
Ratification then is still a long way off.
By then I'll have been financially "crippled" for 12 years!
In the meantime, I'm hearing that banks are starting to check with the likes of PC World before black-listing others.
It's those that have been shafted in the past 5 years that I'm hoping that this will help.
All the best......0 -
well done for standing up against these bullies......you should be proud....It is nice to see the value of your house going up'' Why ?
Unless you are planning to sell up and not live anywhere, I can;t see the advantage.
If you are planning to upsize the new house will cost more.
If you are planning to downsize your new house will cost more than it should
If you are trying to buy your first house its almost impossible.0 -
How are other folk getting on with this? I had hoped it would at least be an easy £5000 claim in the English small claims court.0

Rico
Just read your thread - thank you. I'm not sure what the 'easy £7,500 in the English small claims court' would be for?
I have a vested interest, as I've just managed to get Barclays to remove an incorrect and totally erroneous arrears notice from my credit file. I'm about to apply for a new mortgage to move house, but whilst the arrears notice was there I was turned down for a credit card and a credit limit increase for an existing card.
I'm waiting to hear from them what they feel is an appropriate level of 'goodwill', as it's taken up a lot of my time, a lot of broken promises from them and huge amounts of frustration and emotion for me. I have suggested they just cancel my mortgage... (if you don't ask, you don't get!)Mortgage Free thanks to ill-health retirement0
