    Hi,
I had my court hearing today and the defendents didnt turn up. So, the judgement was given in my favour. I was told that a letter will be sent to them...to pay the money.

I am really surprised that they didnt come for the hearing. Can someone tell me what will happen if they dont pay me even after the notice?

    Many thanks

hi yatin, this is where things can slow down! The court has awarded you the money and they are now supposed to pay in full by return.
But if they don't then you will not to pay for yet more services from the court which can include a warranty of execution (which sounds great!) but is a way of being able to get the baliffs in.

Ask the court to send you leaflets about non payment.

    Good luck

Hi mlz1413, many thanks for your reply...I hope the LL might have recieved a copy of the decree notice from the court.

Should I write to the letting agent and the LL asking them to pay the amount within 28 days?
Please could you tell me what am I supposed to do now?

do nothing - the court will have given them a date by which they must pay you - if they have not done so by that date, then inform the court. you must then decide if you want to pursue it furthr - do you want a moral victory or your money back ? as suggested earlier, ask the court for the leaflets re how to enforce a judgement.
  • I wouldn't count your chickens just yet.

And I'd get the name of the letting agent off of your post.

"" And I'd get the name of the letting agent off of your post." - why ??
  • Because common sense says that there is no need to post it - I can find who they are as can the rest of the world now - are B****R the owners or just the agents?

By all means post details of claim and counterclaim but take the names off.

Yatin - this link may help you http://www.courtsni.gov.uk/NR/rdonlyres/D6A8FA76-10AE-4F60-9166-D323DED3E02F/0/creditorsadvicefactsheet.pdf and you can always ask the court staff for guidance. The LA may yet pay up as there are a few days to go before even 14 days from judgement have passed. :smiley:Good luck.

Many thanks for all your replies. A copy of the notice of decree that was sent to me doesnt have any specific date on the form. I will call the court and will find out if they have sent any specific date as a deadline for paying.

Thanks a lot again for your replies.
