Can i just stress that Trading Standards cannot take action against individual cases if it is a CIVIL matter, they can only do it for criminal matters. They can only take action against the trader if he has committed particular civil offences a number of times (under the Enterprise Act) and it is not done on behalf of the individual consumer but on behalf of consumers as a whole...

They certainly give out good advice, and I have known them in the past (not very often) to make a call/send a letter on a customers behalf when a retailer is breaching consumer regulation.

It's not a question of approaching Trading Standards so they can take 'action' - Trading Standards will give excellent (verbal) advice on how to handle the situation - a few years ago, they actually dictated a letter for me to send to a dodgy car dealer (which sorted the problem, incidentally). They'll tell you exactly what your rights are and what legislation (if any ) can be quoted in your letter.

As a previous poster asked, did you pay by credit card? If so chase refund through them
  • Thank you everyone for your advice.

Been on the phone to Trading Standards and they were great. Advised me to write a letter stating ... under the Supply of Goods and Services Act 1982 we relied on their expertise and skill when measuring the 3 girls. They failed to measure correctly. Blah Blah Blah ....

Letter has gone recorded delivery today so fingers crossed they will take notice however I have a feeling that they will ignore. If that is the case, we are going to call Trading Standards back as they have advised and we will proceed to court.

    Thank you everone

Unfortunately we paid by cash - FOOLS!!

We are prepared now though and will be putting anything else in future on the credit card and paying it off straight away.

    Thank you
  • It went like this...

Letter posted Tuesday, they received it Wednesday, we received cheque for all money paid Thursday!!

Thank you so much everyone for your comments and the trading standards guys were great too.

On their advice on how to word out letter they paid up without an argument.

Fantastic and the icing on the cake is we found a fab little Bridal shop in Chester le Street and the service was the complete opposite. 3 new bridesmaid dresses purchased.

    Thanks again.

    Excellent news. Well done.

It just shows that taking good advice, and a bit of knowledge of the law can produce results.

Trading Standards are an excellent source of good advice, and should never be underrated.

Which could also be done by using common sense - I am sure that the OP was more than capable of writing a simple letter herself.

Trading Standards do a great job of stating what is blatantly obvious!

    Great news OP ... x

I'm sure she could have writen a letter asking for her money back but trading standards told her how to specifically word the letter and which part of the Supply of Goods and Services Act 1982 act to quote.

It will have made the shop, who had previously refused to re order or refund, realise that the OP had taken advice and that they were in the wrong. From reports I've heard about that shop (I live in the same area as the OP and my friend who is getting married this August went there to look for a dress and was totally unimpressed with the staff) I very much doubt they would have taken notice of the letter otherwise.
