Paypal Chargeback

I'm having my first real bit of trouble on eBay for a long time! Bit of a long one...

I wanted to order a BIN item from a USA seller and asked the seller about postage costs to the UK. They quoted me postage but told me to just send a payment through Paypal for the item if I wanted it (rather than go through BIN on eBay).

I ignored this and ordered the item through eBay BIN and paid via Paypal, but the seller told me that the order had messed up in their system and they would cancel my purchase by filing an unpaid item dispute. I agreed to this, but the seller said that they would just send out my item as the Paypal payment had cleared to their account. So basically I agreed through eBay that I no longer wanted the item, but had still paid through Paypal - if that makes sense?

I was a little confused by all this and thought that the seller was maybe trying to evade paying the eBay fees. Alarm bells should have been ringing by now, but I thought - what the hell, as long as I get the item, I'm not too worried.

Anyway, now exactly a month later, no sign of the item, and the seller (which is a photography company based in NYC) is claiming that my parcel has been lost by the USA Postal Service. Despite this they won't give me a tracking number so I can check it myself, and are being very cagey. A couple of days ago they said they would send a replacement parcel and tracking number, but again, I'm struggling to get a tracking number out of them.

Am I still able to charge back using Paypal - is there a time limit on this and could I be affected by the fact that I've basically agreed to an eBay unpaid item dispute that I no longer wanted the item?

    you have to start a paypal item not received dispute within 45 days. you will win if the seller can't prove delivery

    the ebay unpaid item dispute will not make any difference to the paypal dispute

    Thanks very much - that leaves me around 2 weeks I think.

    Surprise surprise though, the seller has now given me a tracking number so I can at least see where it is - although the tracking number appears valid it says no info is currently available - I'll give it a few days to see what happens and then start a chargeback.

    Should have chased it sooner really!

    just start the charge back. it take long enough to get going so dont delay!!

    I'm just in the middle of filing a chargeback and I've just tried the USPS tracking number on their website and it says -

    "There is no record of this item."

    The explanation on the USPS website is -

    1. Event information may not be available if your item was mailed recently. Please try again later.

    2. The number was entered incorrectly. Be sure to enter all of the letters and numbers as they appear on your mailing label or receipt.

    Anyone come across this message before?

    Try deleting spaces if you didn't.

    it maybe an international recorded with only tracking on delivery

    You have 120 days I believe for chargebacks. So if you are selling items on ebay I recommend you wait 120 days before dispatching items to avoid chargeback.

    Your advice and your understanding of how paypal works is completely wrong, and also makes no sense at all :confused:

    A seller must despatch within 7 days of payment to receive any paypal protection, so any seller that waits longer than that is taking risks, ebay themselves require all goods to be in hand or deliverable within 30 days. I assume your suggestion of sending goods afte 120 days is tongue in cheek and you forgot to add the smiley?

    A paypal chargeback can be done up to 45 days, so any sensible buyer who has not received their goods at day 44 is going to put in a claim regardless of what seller is saying as otherwise they stand a very good chance of getting conned.

    Well done Sherlock. After being on the wrong side of a stupid chargeback, there is no way you would put a smiley either!
