Perhaps you should tell that to the Banking Industry, amd also to the thousands of tax payers who are now bailing them out through public funding..

I'm sure they are very aware of how the credit referencing system and data protection legislation work.

I don't want and argument here, but I am at a loss as to why you do.

I am totally confused your arguments are all over the place, first post was like warning us DCA can catch up with you so only applicable if avoiding paying and your last arguement is about the government bailing out companies who are losing money which directly conflicts with your first post.

All I know in my experience of debt as a debtor is to be upfront, co-operate with fianance companies but demand fair treatment. I don't like abuses of the system of either side of the lending/borrowing.

Yes agreed but how many people have been questioned for debt that they do not owe,how many people have gone on a DMP,only to find later on down the line the Dca tries to get a ccj against them, these same Dca's couldn't give a Damn whether you owe the debt or not..they just want their money.
My point being is that the same CRA's are supplying the info to the Dca's in the first place.if the info is incorrect which has been on many occasions.. do you see these CRA's saying sorry i think not..
As for going off track with the Government thing, i'm not at all.. just stating a point that thousands of people have lost everything due to bad finances..these same people have to now sit back and watch the Banks who have made more !!!! ups than a debtor could ever dream of, but did they lose everything NO, they get rewarded with Tax Payers money to bail them out.

If you are on a DMP there is nothing to say a DCA can't get a CCJ against you.

There are also procedures for if a debt does not belong to you what you can do.

People sign credit agreements they spend the money - creditors have to be entitled to chase it. There are lines they cannot cross and if they do there are procedures that can be put in place.

Northern Rock was saved to protect the public, the many savers they had and the people with mortgages - it is right that this happened.

    .

Yes true, but don't you agree that if a person who is being chasing for a debt that they do not owe should be automatically compensated, and that the company who supplied this info in the first place should face an automatic fine of £10,000

I am surprised, and disappointed, smf, to see that you need to resort to snappy insults - I actually thought your thread was quite helpfull to anyone who wondered why they may be being pursued by a dca, even though most of us are quite aware of the fact that dca's trawl the credit reference agencies for 'recent activities' that may help them in identifying potential debtors/victims.
Such a shame that you feel the need to snap at anyone whose opinion differs from yours.

I'm not snapping merely making a point, thousands of people have been contacted by a DCA for debts that they do not owe,and if this info originates from a CRA it is bang out of order. how can this be justified. it is also common knowledge that Dca's have been known to give less say favours, to those companies who use info from people filling in surveys.

It can be justified because if the creditor or DCA makes the request in accordance with the provisions under the Data Protection Act that covers the operation of CRAs and the protection of personal data from unfair and unjustified use, then it is perfectly legal and proper for them to do so.

I don't particularly like the process any more than you do, and it is clear that some creditors/DCAs abuse what is an otherwise perfectly legal disclosure of data by the CRAs.

If you have an issue with how a CRA or DCA/creditor handles your personal data then you are within your rights to complain to the Office of the Information Commisioner.
