OSPS Cashback claim problem - HELP!

Hello everyone,

I hope I could get some advise here as I feel I am being ripped off big time by OSPS.

I signed up for one of their cashback deal last year. About two weeks ago I sent off for my first cashback claim as instructed in their booklet and their website with my coupon plus copy of my latest bill. I then got a letter last week saying that my cashback has been rejected because I have not sent my original bill! and all my future cash back claim is invalid as well. I phoned them but after holding on for nearly 30 minute all I got was that mine was a price match deal and in my terms condition there was a clause saying I have to send my original bill. I know I should have read the original terms and conditions but how may people read these laywer style docs? Shouldn't they make this type of condition clear on their website instead fooling people? Is this not breaching trade descriptions act? How can they get away with saying that all my future claims are also invalid now? It is ovious this is to catch people out and ripp us off big time. I will go to citizen advice bureau but hoping some of you here can give my some advice because I am really cheesed off about this.

BTW, pervious years I always sent copy of my bills without any problem.

    Do you think they do cashback out of the goodness of their hearts? They hope that people won't follow the rules and mess up and then they won't have to pay out!

    You have to be super careful with cashback.

    It seems you have broken the terms, and you will see when you read your ts + cs that does allow them to not pay you any cashback at all.

    If you still have time, try sending in another claim with the correct documents.
  • I never got terms and conditions doc when I received my package. When I login to my account there is no terms and condition either, no details of my cash back offer as well but you are right I must have clicked on box to say I agree with their terms and conditions. I still have the my original order confirmation email and nowhere on it does it say I should send my original bill. I think this is not right under trade descriptions act where it is blatant they are trying to catch people out. How can they send you how to claim booklet with instructions to claim and then say you breached your terms and conditions. Shouldn't they say in that book let that if you are on price match deal then you should do X Y Z? I was thinking posting another claim as I still have time but then I will have to use coupon 2 but of course then they will say you have sent us the wrong coupon!

    You may be able to download another set of vouchers (though sometimes they have insisted that only original vouchers are acceptable).

    If you want to try and put up a fight it is essential you do at least get the correct claim into them in the time scale required.

    Though this looks to be an uphill battle. The court won't have sympathy when you admit to having accepted the offer terms without actually reading them.

    I'm afraid the t&c were perfectly clear and available as many have warned ever since they appeared last May. There are no vouchers to download now and you MUST be out of time in any case. Despite being their critic and helping many, I (and others) can't help those who don't do thorough research beforehand AND at the point os sale. I say this once more as a warning to others who may well end up in the same difficulty!
