My option now is to use the Small Claims Court, both for the arrears and the court costs she was ordered to pay.
What a wonderful analogy you have used here to describe the CSA.
Unfortunately I have to be the bearer of bad news regarding your last point.
In simple terms, the 'contract'...if you can describe it as thus, is between the CSA and your ex. Or, with regard to your point of court costs, does this mean you have a private agreement?
You cannot sue your ex nor the CSA (govt agencies can't be sued) through the SCC.
I took this exact issue up the Henshaw Report, but fat lot of good it did.
It would make life so much easier for PWCs if we could pursue arrears et al through the SCC.0 -
Yes I agree Sensemaya - it would open the door to many, many claims - that's why it can't be done I suspect!!!! Mind you, my ex wouldn't have paid even if I had done that - it took for the CSA to take him to court for committal and for the Magistrate to tell him that he was going to prison the next hearing if he hadn't paid, for him to finally give in. It took almost 8 years and he still hasn't paid it all.0

I don't think all this cases have been reported fairly because are you telling me that the sole reason someone has 'called it a day' is because of CSA arrears and there are no other contributing life factors...please.....I live in the real world! There will be more to it in the majority of cases and the reporting is very biased. Typical media!!!Loan-£3600 only 24 months of payments to go!!!

I suspect you are right!
As for your ex still not paying if the claim was successful by way of default judgement ,for example, ( very helpful if they ignore the Court), there are means and ways of getting people to pay up. In fact the very same powers the CSA have at their disposal.
The only difference being if the PWCs were in control, proceedings would be done a h*ell of a lot quicker.
Plus the fact both parties have the opportunity to put both their cases in front of a human being - despite it being a Judge.
So much fairer than what we have to put up with our mutual friend, the CSA!

lol - I haven't met any human judges - just look at the stupid sentences being passed for murder and paedophilia at the moment!!!!! So much for the victims.0 -

seems strange that there are alot of women on here!
as a father spending 25k to try to see my kids which after 2yrs and loads of court time was unsucsessful basically due to mother!
i am now paying csa (this i have no objection to) but she and new hubby dont work therfore dont pay tax etc why should i bail this goverment out with over 150 per week when they my kids get next to nothing of it?
as mother wont let me see them i think being charged anything at all is WRONG i agree there are a lot of dads who dont care about their offsprings but i tried the law is all in favour of the mum even when it was proven they were being subjected to emotional harm!
she still has them i dont see them but i pay for them where is the justice in that?
my life has progressed and i have a new child due soon but it will not get the same amount of money spent on it due to the csa?
i hope they all lose there jobs when the agency is shut down!!!

well your wrong i have and most of it was down to my ex and the csa its a double hit if you ask me you lose your flesh and blood by a selfish cow then they force you onto the bread line by taking stupid amounts of money from you personally it was only my familys support that stopped me and yes i would love to see my kids but they were turned against me by the mum and new daddy, put on at rosk register yet still mum has them this country is wrong out oof date and the csa always say we dont get involved!
well everyone who knows what i have been put through are always shocked that anyone can treat another human like it.
but hey you obviously know best!!!
oh and its not a few hundred pounds its around half your salary which makes it not worth working as you only pay £5 on the dole!
great way to improve society?
finally i know that some dads dont give a s**t about their children but please dont put us all in the same basket:mad:0
