Legal advice regarding satellite dish install

    That's precisely what we have done, other flat owners (not their tenants) have been asked their opinion and they have all expressed a concern that they do not agree with installing a dish since the block had cable installed several years ago.

    Also, people living in Germany may have less covenants to their property leases.

    For shame on you all. Most of these posts are not in the spirit of the MSE forum. Martin is always asking that we be nice to one another. People are going to post personal opinions and hopefully in among the opinions will be details of how to resolve the matter.

    If I was the OP I would call a meeting of the other freeholders - as they are all equally affected. If the tenant is determined to proceed anyway, which he might do, the freeholders need to have legal support ready and waiting if they wish to halt the installation. Therefore he will presumably need a consensus before engaging a solicitor.

    IMPO I would not like numerous individual dishes sited on a block of flats. Far better option to have 1 dish or cable giving all flats access if required.

    We're not talking about numerous dishes. We're talking about 1.
    Why does 1 extra dish on a block of flats look any worse, than 1 dish on each house in a row of terraced houses ? :confused:

    I've got 2 dishes up on robowen palace !! Nobodys complaining ! :doh:

    If this bloke was english, then ...no problem. Give him access to the previously installed system.

    In a muticultural society.......as so many people keep banging on about.
    Why can't this bloke have an exemption to this stupid rule, on the grounds that the previously installed system doesn't cater for his language ?

    and...no. Everyone else would not jump out of their chairs to get a dish put up if you let this one go.

    Judge each case on it's merits.
    Take a £100 retainer/deposit if need be, to ensure the dish is removed when he leaves.

    Look on the tops of all tower blocks and tall buildings. Dishes everywhere !

    It does not affect the property value by putting up a dish.

    wouldn't 1 dish cost a fortune? IF it was for Sky tv then wouldn't that be treated the same as a pub having Sky and charged accordingly?

    If there is a european law regarding his right to install a sattelite dish. You may find yourself stuck.

    Since signing the Treaty on European Union (also known as the Maastricht Treaty) in 1992, the UK has co-operated closely with its European partners in political, economic and legal affairs.

    This means that laws and trade agreements established by the European Union are legally binding within the UK. In fact, the European Communities Act 1972 ensured that European law takes precedence over all domestic sources of law.

    This means that if there is a conflict over UK and european law. The courts will have to decide in favour of the european law over uk law. This is why you see a lot nowadays, when people fail in the UK courts, they appeal to the european court.

    Of course not - pubs pay more because they are installing sky for commercial gain. It would cost more for one dish as it would not be installed by sky (as the main user is not using it for sky). However, the installer could put an LNB for sky on it and run a cable to the flat of anyone who wants it no problem - when sky arrives just tell them you've got the dish already and they just need to connect up the box (they'll hardly complain!!).

    Personally I think the dishes look a mess. Locally blocks of flats and houses in multiple occupation (we have a huge student area) are not allowed mutliple dishes anymore which has vastly improved the appearance of area's heavily populated with flats. I think dishes are up there with dormer loft conversions for ugliness. They spoil the original symetrey of houses. Luckily where I live people pride themselves on good taste;) and my road doesn't have one dish on the front or side of the house spoiling the appearance. A few years ago if I was to go to one of the more deprived areas I would have seen a dish on the front of virtually every house. Council has now prohibited this as they have had European money to restore the facades as the houses to their original condition and dishes are banned! The rows of terraced housing now looks superb. The lucky homeowners had all the work for free I don't think they minded losing their dishes as a new roof, re-rendering, new doors & windows etc was enough compensation.
